I'm in the process of selling my car the blokes made a deposit, very little 100 hundred :/
Anyway I've got the paperwork but I've just learned the car has to be sold with RWC, the car has 11 months Rego on it.
From what i read in the forums you have to hand in the plates to Vic Roads and have the rego suspended.
and you have 28 days to get a RWC and new plates and the cars can be renew its registration (11 months rest)
Is this correct?
Not too sure bout the rest but I have sold a car without a RWC at the buyers choice and have bought 2 cars without a rwc.
All u got to do is make em sign an external agreement that they will be handed the keys without a rwc and that it is up to the buyer to get one.

When he left the deposit did either of you mention a RWC?
By the letter of the Vic Roads law you have to, but if you advertised it without a RWC and hes agreed to that, just make sure you write in the receipt that you will write out, sold AS IS without RWC.
Make sure you make sure that he actually gets a RWC and transfers the rego. I got burnt 6 months after selling a car I learnt it was still in my name when $150 worth of tollway invoices rocked up at my door.
Yeah I never quite understood why you Mexicans need to sell a car with a RWC.... Here in NSW, you buy a car its up to you to obtain a RWC, regardless of its age or condition :/
Pretty sure if you're selling a car with rego then you need to sell it with a valid RWC.
Otherwise, sell it without rego and without RWC. Cancel the rego and get some money back.
You can sell it with out a rwc just get them to fill in the rta form and whan you take your part to the rta they will than change the rego into the new owners name and send him a letter saying he has 28 days to provide a rwc or they will cancel the rego on the car.
No, Although in the add it was It said I wasn't supplying one. But I did say I can arrange at there expense.
But he mentioned nothing of the sort to me when the deal was made so i assumed he would be getting one.
Thanks for the heads up I'll be sure to mention it in the contract
It just pisses me off that he wants me to do the RWC when its his responsibility in the first place, as claimed in the ad. As he didnt mention that i would be organizing it. So Im more money out of pocket, when his already getting the car for $1200 cheaper
I've sold dozens of cars with no RWC. From what I understand the new owner must present a RWC to Vicroads issued not more than 28 days before the sale date to transfer the rego to the buyer. The RWC may be obtained by either the buyer or seller. Not sure where the legalities are if it is not mentioned in the add one way or the other.

Registered vehicles
A registered vehicle must be sold with a Certificate of Roadworthiness (RWC). You can still transfer registration up to 3 months after it expires. After this time the registration will be cancelled.
Seller’s responsibilities
provide the buyer with a Certificate of Roadworthiness that is no more than 30 days old when the sale takes place.
fill in the ‘seller’ part of the Application for Transfer of Registration form [PDF 339KB, 5pp]
Unregistered vehicles
An unregistered vehicle can be sold without a Certificate of Roadworthiness.
Seller’s responsibilities
cancel vehicle registration, remove number plates and return them to VicRoads. Refunds on registration are available if you cancel registration before it expires and the registration was in your name.
shouldve sorted out rwc before commiting to lowering the price.
if you listed on the ad that he has to pay for rwc, get some more money off him, go get a rwc, if theres anything that needs fixing, get him to pay for it.
otherwise, jsut cancel the rego and sell it with no rwc.
the seller is obligated to supply a rwc if its registered the day the sale takes place, regardless of how it was advertised.
Simple process, three choices.
(1) Get the RWC at your expense and go ahead with the deal.
(2) Tell the buyer what the RWC will cost and get the cash before you get it done.
(3) Give him back his $100, get the RWC, then advertise the car again.

Thanks for the clarification, the buyer wants a RWC either even if it wasn't part of the deal. At his expense though not mine
So the car passed roadworthy.
For example say i brought the car, when they transfer the car into my name, does Vicroads assess the car?
Do they go over it again?
because I've been told they do, but it didn't happened to me when i transferred the car last year into my name with rego.
Its just i took the SSl's out of the car to get a roadworthy. And the bloke brought the car with the springs, so i need to put them back in.
