My vl calais was defected today and send to regency?
I was also fined 257.00 for an unroadworthy car, in was unaware you could be fined for this?
My defect was for a loose seat
Oil on the motor
and darker than legal tint.
Do i have a good chance of appealing this fine and winning
Note also i only just brought the car and had only owned it for a couple of hours.

They would have got you for the tint firstly which is definately a defect,but then they wanted to find anything else they can ping you for so they went ahead and did that but for having oil on the motor thats a loud of bull.You have no chance appealing the tinted windows

On the paperwork it gives the option to contest, so im assuming because they just make up Bullshit to get the revenue

I'm from victoria so this might be different, but did you get a Roadworthy Certificate with the car? If yes, you can say to them this is the piece saying it's RWC which would include the 3 things about the car which is wrong, and the people who supplied the road worthy cert would have to pay for everything to get changed. (basically dodgy Road worthy)
Did you inform the second cops that the first ones told you to get it fixed

Of course they can make up bullshit so what they need to do is actually photograph the defects as proof so if they didnt do that then what I might do is go and get the 3 things fixed up quickly and then contest it and say well the cops lied
Mate it wouldnt surprise me if the 1st lot informed the 2nd lot to pull you over and defect your car

That's why we have such things called Services.... If you do your own service, then you should have enough knowledge to know where an oil leak is coming from. Yes they can spring up at any time, but if you keep your car serviced regularly, then you should be able to note down any oil leaks, even if its very slight. If your not that smart, then you should be taking it to a Mechanic and they should be writing down anything that's wrong with it, including any leaks. Yes it's plain revenue raising, but someone has to keep the cops wages going.how am i suppouse to know it is unroadworthy?
No way around it mate, Suck it up, pay the fine, get the defects cleared, then try not to have anymore illegal mods on your car (ie dark tint)

Yes but he only had the car for 2 hours and didnt realise that it would be defected surely he should have been given a chance to rectify the problem considering the time frame of ownership

In that case he should of taken it to a Mechanics first to have it checked out before buying it, or get the sellers to get a RWC for it, that way if the cops pull you up, you can stick that in their face.

Did you even read what I wrote properly? I said you should of taken it to a mechanic prior to buying to find out what could be wrong with it. OR the seller could of gotten a RWC, since you have not stated in any of your previous posts what state you were in, it was easier to cover all area's.... It doesnt matter if you'd owned the car for 2 hours or 2 years. If it's unroadworthy, you're going to get a fine for it. You cant drive an unroadworthy car on the road, and then complain when you get defected. Didnt you check the car out before you bought it?
Just cough up the money and fix the car, then you'll have a car that's legal to drive around and wont get hassled.

Considering that a car being roadworthy is purley up to the descrection of the officer, thats a serious problem.
For instance, in VIC, a cop can pretty much defect you for anything they like and just say thats its unroadworthy. If thats the case, there is nothing stopping them from jsut fining you regardless of if you car is roadworthy or not.
From a 3rd person peespective its very easy to say to someone 'you should have a roadworthy car' but when cops can decide based on their opinion alone what is raodworthy or not (until proven otherwise by an authorised roadworthy inspection office), its a harsh deal.

They don't use opinion (traffic coppers) there's rules. Illegal tint is illegal, a loose seat is obviously dangerous and oil leaking from your engine is in the same category.
