Been having a problem just recently with the daily

1998 BMW E36 - 318is (M44 engine)

* From a stop start, i would slowly release the clutch to TRY get it moving and then once the box receives a little bit of load from the engine the shifter pops out of first and into neutral.

* Second attempt the box engages and will run fine until a number of stop starts

* Happens 'occasionally', not all the time.

* 9/10 It will definitely happen in the morning when cold

* No matter how FIRMLY i put into first gear, it will still happen.

What do you guys reckon, has anyone experienced this sort of problem with other cars?

*It's got 214 xxx k/ms on the clock
*Clutch is due for replacement soonish > car drives fine, though pushing it thru the higher rev range it will slip.
*Transmission fluid is topped up and in ok condition, though hasn't been serviced in a year.

Should there be an adjustment some where amongst the shifter?

--> If i have to, i really don't mind spending $500 on a second hand box and a new clutch. But if it's just a simple adjustment somewhere i'd rather save the $500 and have a new clutch only.
