i need some advice. i'm not much of a poster on the forums. i'm more of a buyer and a reader.
Im in abit of a mixed mind about which path to take in a insurance matter, 2 nights ago i was stationary when i was hit from behind in my commodore by a 4x4. i am not completely sure if she was distracted or what but needless to say she hit my car at around 60 kph. the back of the car is completely destroyed and the force was quite great. It pushed my car into the opposing lane, The car that was approaching in the opposite lane didn't hit my car but ended up about 30cm's from my drivers door.

once everything had stopped i got out to make sure the driver in the car behind me was okay. she was okay just very upset. i called the police and moments later they were on the scene. they helped us exchange details ( both me and the other driver on our P's ) and gave the breath test. all fine. my car was towed to a holding yard and when i was given the all clear to leave the scene from the police i did so.
THE NEXT DAY!
the following day i called my insurance company to inform them i was in an accident. i had all the details required except which provider the other drivers were with. so i gave them a call. they asked if i was alright and vice versa. i was then passed onto the female drivers partner and asked if i would like to seek payment for my car thru them directly rather than their insurance company.
its not the best vs commodore out there. but its in excellent condition and was purchased only 5 months ago for $3500. since then i have put on an extra rego (only had 3 months at time of purchase) had regular checks and kept it in the best condition i can.
Should i go thru the other driver privately or should i just leave it to the insurance company?
which will be the better option for me?
which would benefit me more?
has anyone had this situation before? if so what did you do?
I'm really stuck, i honestly don't know what to do. please help.
go through the insurance company mate sounds like they may try and rip you off ey
As it's a rear ender you shouldn't pay any excess nor will your premium be increased as you wasn't at fault.. I'd go through your insurance company as all work will be covered ect Also for what is described it'll be a right off (personally speaking)

As caaf said, not your fault so they will have to pay everything through insurance. Unless your brake lights werent working then you might be in trouble.
Yeah make the claim through your own insurance. They may be genuine but you don't know them from a bar of soap. Don't give them any opportunity to shaft you. My first thought when you said they wanted to do it privately was that they're uninsured and telling you that they are insured.
Also an important lesson from this is not to turn your wheels from dead centre while waiting to turn right. When you get rear ended hard enough, (as you have discovered) you get pushed in to incoming traffic.
Definately insurance, my mate had the same thing happen to him, and needless to say they are still paying him and very slowly at that, NOT worth it! Just get your car fixed in one hit

Do you have comprehensive insurance - I can't see it spelt out clearly in your first post but as you said you contacted your insurer, I assume you do.
If you do, ALWAYS put your claim in through them for this sort of accident where you are not at fault. They will pursue the other driver for the costs and pay for the repairs to your car, or pay you out for the insured value as it's a write-off. You will not have to pay any excess. This is the greatest advantage of having comprehensive insurance - your company does all the dirty work for you. All you have to do is get the car to a panel beater and they should arrange for the vehicle to be assessed by the insurer's assessor. Once it's written off and the insurer is comfortable with the fact that the other driver was at fault, you shouldn't have to do any more, except wait for the payout.

you don't even need to know who their insurance is with. You just give their details to your insurance company and they will sort it all out for you.
If you were going to do it through the other guy i'd tell them you want 4 grand cash tomorrow and see what they say .... but why bother, your insurance company will sort it all out for you. They must be stupid or uninsured to ask you if you want them to pay you directly.... their excess has to be less than $3500 so why would they want to pay you themselves ?
Chances are they dont have insurance. Too bad for them. Your insurance company will help you out then take them to court to recover the losses
