Parking fine dispute

Got a parking fine notice today and they got the street name and time wrong on it! They said I parked illegally at 01:00PM(while I was at work that day) on Red Way, Rozelle (this street doesn't exist)!

Do you think I can get away with it if I dispute it? I can get someone from work to write a stat dec saying I was there that day and also show in the street directory that there is no such street as Red Way ha ha!

I got a parking fine once when i had the paid ticket sitting on my dash...so I mailed a letter to the "suchandsuch" person that handles it all and they sent me a letter of apology amd rescinded the fine.

yeah just send a letter. I have recieved one of those parking tickets, City of Adelaide council, wrote them a letter, copy of the ticket, and i was freed from the ticket.

I'd say its a no brainer that one... you'll get out of it for sure. I have only been fined once for parking too long in a 2 hour zone, but only because the other side of the street was no limit so i assumed this one was too!! dang! (Paid it straight away btw)

Im on his side, don't park illegally and you won't get the fine.
Tell me this, the street doesn't exist, is it mispelt or completely incorrect, or did he just put st instead of rd.. Or something pathetic like that.
I just hate the worlds attitude - no longer does anybody want to cop the punishment for the crime they've committed. Everyone wants to get out of it and it pisses me off.. +1 rep point for scopes

Paddy were you illegally parked somewhere? What was the name of the street you were parked on. If you are just trying to weasal your way out of paying a fine you deserve because of a small spelling mistake then shame on you. If that is the case I think scope is more than justified in his response.

Nothing I hate more than people who do the wrong thing and come here and sook and look for ways out of paying for their mistake.

i really dont think hes sooking Julie, hes just asked if they have made a mistake saying hes parked illegally on a street that doesnt exist has he got a foot to stand on. How does scopes response help anyone out? This is a forum, hes come for help and advice, and this guy hopes they double his fine. Doesnt seem helpful, shouldnt really post then.

Both the time & the street being wrong is definately a reason to question the fine. How do you know it hasnt fraudulently been issued ? I would send them a nice letter outlining your concerns & go from there.

Ok just to clear up a few things, yes I did park illegally, the name of the street was Red Lion St, Rozelle and it was at 10PM and the notice says Red Way, Rozelle at 1PM.

There are two major mistakes in this notice, firsty there is no such street as Red Way and secondly I wasn't anywhere near Rozelle at 1pm on that day.

I'm not sooking about it I was just asking a simple question because in other countries a technical error like this on legal document/parking fine/court summons would make it invalid and I was wondering if this is the case here in Australia.

Were you parked on Red Lion St or Alfred St/La??? By any chance?

What are the between streets. On NSW parking infringement notices it has a between ??? street and ??? street shown. The time is really not a big deal, they go by their watch, and if you were on one of those streets then its quite possible they didn't push hard enough and only prat of the street name has come through on the carbon copy. And that wont get you out of it.

Technically you wont get out of it, on that basis, but realistically you probably will, as I worked in Balmain for quite some time and parking inspectors are notorious for not showing at court matters there...

But what I said would still be the case, I would want to see the original copy first before I took it to court. The 1 pm thing is most likely just that the '0' didn't come through on the carbon. It happens all the time. They will probably just send a copy of the original through to the court and not even show up. In that case it will be up to the magistrate if he accepts the original. And if it says Red Way ROZELLE between Darling Street and Evans Street at 10pm then you're F@#KED.

If you parked there just pay the fine, its what 60 or 70 bucks? Better than a day off work, and you won't get reimbursment for your days pay...

Paddy... if you go to court and WIN.... ask the magistrate also to award you 1 days pay or the time you have missed work, also for legal costs if you have any... he will award them to you.... that's why most parking inspectors wont show up... if they dont show, the case goes in your favour and you win anyway....

who is the company who issues the fines? i'll just pass the above details on and see if they can fix it up.
Like scope said, do the crime, do the time. get over it and pay it. If you get out of it pass the money you didnt get fined onto the childrens hospital this weekend.
