Hi, people i have just got a vt ss 5.7 last night from a car yard. I got it home to find oil leaking from back of the engine. Does the car yard have pay for this to be fixed as it was sold with a road worthy and Australian warranty Network package for 3 years?![]()

The Australian warrenty network hand book said they do not cover oil leaks but i would think the car should not be able to sold with road worthy with out being road worthy
does this oil leak make it unroadworthy?
you should ask some mechanics that do roadworthy inspections rather than what others "think" from here...
my advice when dealing with the dealer over this issue...."please" and "thank yous" will get you further than abusing and threatening them....money has changed hands and unfortunately they've got the upper position in "negotiation" now...
dude, you ahve 3 days to hand the car back. it wasnt given to you int he condition you bought it for.

i think i might need to get some legal advice
i once bought a car with a dodgy safety certificate ... i took the car to QLD transport inspector .... he said the only 2 things he can check for is rust and chassis cracks .... anything else the mechanic just says "it was okay when i inspected the car ".... taking them to court is useless ... seems like the law goes to the crooks advantage ...
considering the cops can defect you for an oil leak the car is not roadworthy so they should have to repair it.
You have an unroadworthy car.take it back and kick up.
Damn straight, I once saw an EB falcon in the car park at uni with an unroadworthy notice under the wiper for an oil/fuel leak. One of the ACT governments mobile revenue units had hit the place and basically chucked a random defect notice on any car more than 10 years old. Made me damned glad I was driving the AU that day. They would have had a field day with my old car.So oil leak = defect = unroadworthy = car dealers problem.

Yep... As minux said, 3 day cooling off period... They give you your money back minus 1% I think.
Otherwise tell them you want it fixed under the warrenty. No need for legal advice dude, unless they wont take the car back.

This advice is extremely misleading. THE COOLING OFF PERIOD BECOMES NULL & VOID ONCE VEHICLE IS DELIVERED! He's also clearly stated that oil leaks are not covered under his warranty. Leaking oil does not necassarily mean it wouldn't pass a RWC either.

And about the cooling off period, I was thinking about it today and couldnt remember if the 3 days is from the day u sign the contract or the day you actually get your car... It's been a couple of years since I did this stuff, thanks for the correction

Depends who's doing the RWC, basically I'd be taking it back and raising hell, because you CAN be defected for it. Dampness, weeping and staining are all symptoms of a leak that is so slow the exact source is difficult to identify, and in NSW I still got pinged on my blue slip for a weeping fuel sender gasket. So it can happen. Solution, wiped the bastard clean, took it back BINGO roadworthy. Wouldn't be surprised if the dealer pulled a similar stunt.

Similiar thing happened to a mate of mine, took the car for a test drive, had a good look over the car, signed the contract and when he went out to the car the morning after he had a tyre that had a slow leak (dealer had pumped it full up to hand the car over obviously) and the spare wasn't the same spare he saw the day prior
Within two weeks the exhaust had a hole in it (dealer's mechanic friend had puttied up the exhaust and then resprayed it to make it look like new)
All this from a car that by law had to come with a RWC but just goes to show there are some shonky dealers around

EVERY car sold by a dealer 2nd hanh has a statutory(sp) 3 month warranty period. Oil leaks will be covered by this, especially because its just after 1 night. No dealer will tell you this, as they'd rather 'sell' you there warranty as they get a commision from it.
Personally i don't think its that bad, its probably just a seal has deteriorated over time (being a VT, around 99/00).
Although, in your position with the rights you have, i'd probably get my money back.

I had to take my car back to the dealer 4 times to get things fixed... unfortunately I'm still finding dodgy fixes of things coming to pieces, well after my 1 month statutory warranty (before you say its 3 months, car had 175000kms on it, making it 1 month only... might be different outside queensland.)
I think you'll find they will just do the cheapest dodgiest fix when you take it back. I was without my car for almost a month due to taking it back 4 times, and still havent gotten everything fixed. (cruise control doesn't work)
Hassle them if you will, but it will probably a painful experience.

but mine was only a month... the rules are different in queensland I guess but rules is rules. For 3 month statutory warranty the car sold must have less than 150,000kms on the clock and be less than 10 years old. If either of those conditions is not met then you have 1 month. It is at the dealer's discretion whether they provide a warranty longer than that, but those are the minimum periods for statutory warranty (in qld at least)
