It would be if your still holding the phone (as I see a lot of people doing).
If you have it in your lap or put down somewhere I'm not sure, but it could be because its still a distraction.

    But wait... There's more!!

    But that's not all!!!

You are just better off getting a bluetooth headset and using it whist your driving...its so much better, clearer, loud and no miscommunicating...you can get ones you can charge in the car as well...I bought mine from Officeworks and the only problem ive had is that I forget to charge it once a week

It is only legal if A, you use a handsfree kit or Bluetooth headset or you pull over.

I thought it would be legal ... as far as i know loudspeakers are classified as handsfree. i've used my loudspeaker on my phone while driving (not holding the phone), can't see why it wouldn't be legal as it's the same as a handsfree kit just without the earpiece?

i agree with the bluetooth earpieces though, they seem like a good idea.

Because to answer the phone or hang up you need to access the phone, to use the speaker you need to turn it on once you have received the call. Again handling the phone.

Bluetooth headsets rock, one button to answer, double click the button to call last number. Setup all your numbers with voice recognition so you speak and it will dial.

I use the speaker phone on my phone (samsung d500) all you do is plug in the external speaker in before you drive off. So you only need to press one button to answer a call, so there is no way the cops could say you were using your mobile as I can leave the thing on the cup holder or passenger seat and it's very clear.
But if the cops see you holding the phone than they would book you for using your mobile phone while driving.
