    Default loss of licence questions

    Ay guys I just got home, from a regretfull night of going out. This is how it all started, I pulled up next to a subaru wrx sti.. he started to stall it up anyway I didnt bother to race him. Though next to us that we didnt know of, was a unmarked police car. holden ve ss lowered, dark tint, some sort of exhaust system ( sounded louder then stock )

    So I took of as normal, accidenlty cutting into the next lane so I just went into that lane quickly. Which was my fault of course, so I sit on 80 then the VE sits up my ass and pressuring me to go faster so silly me got sucked in to doing 20 k's over the limit.

    This is were the story gets interesting.

    He gets out of his car, calling me a tool and if im aware that my car may be impounded, I ask why, he replyd I know why. Then he goes ahead and tells me he heard my wheels spin when I took off, I didnt take off nor did I stall it up.. the wrx did loose some traction though. So I explained to him that, though then he starts calling me a liar. And if I told him the truth he would of been less harsh on me.

    Anyway he goes back to the car, then comes back out. And starts taking pictures of my rear windscreen then got back in his car.

    Finally he comes and lets me know what fines I have recieved.. Firstly he said that he wont be impounding my car due to his partner talking him out of it. Then I cop 3 fines a total of 12 demerit points on my P's.

    Fine 1: Speeding 25k's over limit (my fault no problem)
    Fine 2: Changing lanes without signal (my fault no problem)
    Fine 3: Cant see P plate? Yeah ok? my P plate is on my drivers side. And it was ON at the time, though he said he knows its on but cant see it from 200m away?

    Whats with fine 3? I have darkest LEGAL tint and I get done for that? I can clearly see the P plate and will take pics when I have time.

    Also my other question is, do I have a option to go on a good behavior license?

    Also theres just to say, they are out this easter and be carefull guys. Also guy told me next easter it will be DOUBLE demerit points

    you're in vic yeh?

    for points accumulation,you can usually choose 3 months licence loss, or 12 months no points, which means any demerit point offence in 12 months gets you 6 months loss of licence.

    you might get 1 or 3 months instant loss for the speeding too, which you will serve first, but it will take a month or so to actually kick in.

    maybe take the car down to the cop shop and show them the p plate and the fine, they might reverse that one.

    how did you get 12 points?

    p plates = 3 points
    25kph = 4 points
    changing lanes looks like 2 on the vicroads site

    You already know it, but you made your own mistakes.

    If a car tailgates me, i drop back a gear. If he doesn't back off, we go down another gear. They eventually get the message. In your case, that would've saved you a fine. The lane change is abit harsh. Considering the WRX would've been an easier target.


    With the P plate law, i had a cop fine me for not displaying the plates, when the corner had fallen down. Quite obviously he could see i was a P plater, so the plates were displayed correctly. In the end, I screwed one to my number plate, and never had another issue with it.

    i did that wit mine aswell but i had it parked near the pub some1 ripped it off nd wen i got in the car (it wasnt even running) the cops pulled up nd gave me a fine im startin 2 think they ripped it off cause otherwise how would they kno i was on my psnd also i did get out of the fine cause 1, the car wasnt runnin 2, i was in the pubs private car park. If any1 has been 2 the hotel crown in victor harbor i was in the dirt carpark right up next 2 the bottle shop

    P plate must be CONSPICIOUSLY displayed. If it's behind tint and difficult to see - no good. Hence the reason why picture was taken of it - to brick you in as there's more than enough evidence to prove the charge.

    Sorry, I'm not certain of which state you're in. In Victoria we do have the demerit point bond option. It's a 12 month bond where if you get hit with any demerit point ticket within that time you end up losing it for longer than what you would have originally lost it for.

    The the OP, Im with stealthy, the closer they sit, the slower I go. I have had instances where I have done 15 in a 70 zone until they got the point. Just the other day I had a marked car sitting up my ass in a 60 zone. So i slow down to 50, he was so close I could not see anything in my mirror except this idiot and his windscreen. He got the point at 40 and when the mrs turned around and started the video camera.

    Realise that these days, a lot of police are power freaked morons that think they are above everyone else. While the goods are still around, it is rare.

    Yes I understand that, though I have darkest legal tint, I didnt choose to make the back darker either its the same all around. And my P plate is up? I really do not understand this one? im doing everything right in the book. Defntley taking this one to the police station to have a second opinion.

    Thanks for the info though so far guys, Think I might take the 12month good behavior bond.

    Also due to the speeding fine ive lost my licence for a month, then the other 2 fines. So ill probably loose my license for about 3-4months yeah?



    Also neat car stealthy. Think I might copy you with the P plate..

    Stick up a pic of the back window ,there are a few coppers on here that are more than willing to hand out good advise and they will be able to give you an honest opinion on if you can take that part of the fine.

    Not signaling - 2 points
    P plate - 3 points

    So will it be about 3months loss of license? if I chose to go that way.

    I have lost points before this making it harder I think?

    In SA, theres 2 types of fines you can receive for not displaying P plates.

    If they fine you for not displaying a plate correctly, its just a fine. If they fine you for 'not displaying p plates' you will automatically lose your license, as a breach of P conditions.

    Since SA seems less strict on other offenses, i would say thats your best outcome, but i don't know how vic do it. Maybe PM Viccop, he would know exactly i'd think.

    Yeah see im not sure whats going to happen, because I have been caught speeding before and lost 2 or 3 points I think. So will that not help how long my license is suspended for?

    Just checked again.

    I actually got 3 points taken away from me for the P plate, 2 points for not signaling, 4 points for speeding and disqualified for driving for one month!

    So confusion in my head right now, due to I can take the 12month good behaviour, but I dont know exaclty how long my license will be suspended for.

    Don't think so negatively, when i went to court to get the good behavior bond (for not displaying a p plate correctly....), the girl before me had 2 drink driving convictions, and still managed to get her license back.

    Noy, get a letter and some info regarding why you need your licence and have all your facts ready to go once you get into court. If you get it back just take it real easy hey. drive only when you have to you know. All the best mate

    speeding fine, 1 month = 1 month loss, no ifs buts or maybes.

    then, because of points adding upto over 5 points for p platers, once you've served your 1 month, you will receive a letter and get to choose 3 months loss or 12 month good behaviour. i learnt this when i lost mine.


    my opinion, do the 1 month, dont complain about that, you know you did wrong there. goto cop shop asap and talk to them about it. tell them then and there you will be happy to move it to the numberplate anyway. you might get the p plate points removed, you might not. either way i think you will still be up for over 5 points.

    then its your choice. if you need the car for work, take the 12 months, its easy, im almost done on mine without a worry. if you can go another 3 months without the licence, do that. (i couldnt, 6 months was enough for me,and i have to drive 30ks to work)

    Yeah considering the 12month option, though that has to go through court first yeah?

    Also once you have finished the 12month good behaviour do you then finish your remainding years on your p's? or do you have to do the 3yrs again?

    Also so all up probably 6months suspended license? due to the other 2 fines.

    Thanks for the info hakhawk. Went to the cop shop today, the guy said because he wasnt there so he cant comment on it and I would have to get in contact with the officer who gave me the fine, and he was just a smart ass, so im not even going to bother trying to contact him.
