In one photo, the brake lights are on. In the other there off. You guess which.

If she is driving a manual she could be using the gears to slow down, then instead of sitting at the lights with her foot on the brake, she could be riding the clutch.

I think it's funny you rant about her using the phone in the car, and you use your phone to take pics of her :beer chug:

melbourne drivers are jus as bad i lived in qld as a driver for 5 years and in melbourne for 4 almost now i see the same sort of driving in both places neither state is any better. almost every week i see cars with no brake lights most are ford true enough brake light switches are a notorious problem in them

if someone has no lights working and gets rear ended would they be at fault?

i have been told if you rear end someone it still your fault with or without brake lights working. its your word against theirs, you have to drive a safe distance behind to avoid the accident something along those lines.
