I just got pulled over and fined $300 for apparently talking on my phone. I know they didnt see me talking on it because all i was doing was checking the time. I just looked up the law and it says you must not call or text on a phone while driving. What does anyone think should i go to court or just pay it. Its a big call as i only have two points left and the fine is three points.
U could contest it. as the phone company will have info of your incoming and outgoing calls, and sent and reveived txt msgs.
by the time u take it to court, u may gain another point. So if u lose, u will have 0 pts.
I contested a fine i got, a cpl of yrs ago... so by the time it went to court i had gotten of my P's, it worked well.

I would challenge it write into the police and explain your story i had one dropped for failing to stop at stop sign and not displaying a permit I had the $564 fine for no permit dopped but admitted not stopping and just dropped the 165 fine. all Victorians can get one fine dropped if driving record has been ok in 2 years I hope this helps. Go to the victorian police website it is clearly there about what you can do. Cheers

My cousin got done for talking on the phone, funny thing was he didnt have a phone, he was scratching his ear! still got the fine and all the red tape and bullcrap he just ended up paying for it coz it was his word against the officers......

If i was you i would cop it on the chin and then contest for that 1 point last chance thing.
Prob the best chance you have of keeping your licence as these types of fines are not really fightable, even if you wernt talking your still not aloud to hold it etc.
