    Leaving the scene of an accident is an offence.

    Wel all have to give way to our right.

    And as has been said, if traffic is on the round about, then give way until clear.

    No such law on roundabouts, as mentioned, its give way to traffic already on the roundabout. Even if it is the opposite side.

    if the traffic is coming around a roundabout then it's going to be on the right

    Yep but the law states you have to give way to everything already on the roundabout meaning if the person coming in from the left of you and crossing your path was a fraction earlier, even if they are crawling, or you hesitate and they don't, it doesn't mean you can hook in and smack into them because THEY didn't give way to their right. - technically they were in the intersection first and technically they are to your left so you must give way to them.
    Sounds like slim pickings for this case but believe me it isn't.

    Hard to understand and can't be effed with a picture but when you live in one of the most heavily roundabout-populated cities in the country you learn the rules pretty fast.

    I have to deal with the same bullshit as well mate atm. To insurance companies it is black and white they read to road rules out of a book and don’t take anything else into account.

    I think the confusing with the give way to right thing is that a round about is technically treated as a round road... and each road that joins onto it is techically a T intersection.(Sorta)

    This is also the reason you should technically indicate LEFT to leave the roundabout.

    ANYWAY!

    So whoever has entered the round about first, has right of way... which in most cases will be the person on the right.

    But as someone said if you enter the round about slowly... and someone is flying through it on your right and smacks into you... if you were in the roundabout first, you're in the clear.

    Haha i'm a Warrnambool boy too mate. Round abouts are in my blood too.

    It is definately give way to anybody who is in or entered the round about before you.

    Couplea things here.

    The law that says you must give way to traffic already on the roundabout, will have you behind the 8 ball to start, but it is not unwinnable. You need create doubt as to the testimony of the other driver, so that no matter what they say, the magistrate takes it with a grain of salt.

    You do this most effectively OUTSIDE of the courtroom.

    When you go to court, the magistrate will have almost made up his mind as to what went on already. If you're planning on going to courts, make sure you have already asked the big questions and insinuated some stuff. Ask Why did they flee the scene ? don't say leave actually say Flee. Is the same driver who's details you were provided with the ACTUAL driver during the accident.

    Yes - the law states you must give way to traffic already on the roundabout. What will be in your advantage is that no-one can prove who was on the roundabout first, because there was no overhead camera that could see both sides at the same time. You and your GF must stress that she was taking it slowly - for whatever reason. You have to leave the magistrate in doubt as to who was on the roundabout first.

    So - Stress fleeing the scene, Stress Driver identification. Provide a Reasonable reason for your GF to believe she was on the roundabout first - with out referencing the other drivers speed. Let the magistrate assume that.

    Do all that and you have a good shot at it. AT worst, you will be asked to pay court costs, and they will be as little as $70 depending on the time in court. If your opponent hires a lawyer, and you lose, you will be up for your opponents legal costs.
