the only insurance i have is CTP... now my question is...... if someone hits me. (and im in Right-of-way) do they have to pay for the damage? (the their insurance company)??
2 people nearlly hit me (in the space of 30seconds!!)
and after the first one i was like "damn i shoulda let him hit me"
then i was at the round-a-bout. in my lane to turn either left or straight through...
and the guy was in the "Right Turn only" Lane we both went through at the same time and he just merged into my lane....i had to slam on the brakes to avoid it but the instantly thought wow coulda had that spray job i so desperately want/need....
lol i know it's not a very "nice" thing to do...but if it gets me a paint job...(COME AND HIT ME!!)...lol
any thought's?????????/

I'm fairly sure that their insurance company gives you (or your insurer who will pass it onto you) the payment, and the person who hits you repays their debt to their insurance company through a higher permium monthly payment
They hit you, they pay, but they will most likely write your car off before a full respray.
really?....well that sucks...so if they they scrapped all up the side of my car.....from quarter to quarter.......it would be written off??...
and would i then get like the market value for a VR wagon??

If the cost to repair a car comes to (from memory) 75% of what it would cost them to pay it out.. they'll write it off... So depends what they would give you and how much it would cost to repair
Generally, if the cost is more than about half the value of the car, they will give you the market value or your insurance agreed value(if you have that)
That sorta damage on a vr at market value, and its a write off. They may just pay you the money and let you keep the car, i know thats whats happened for a mate of mine.
You have to understand that its not going to be 100% their fault. Normally the insurance company places atleast 15-25% blame on you just for being there, so if you fail to brake or attempt to avoid a collision its going to be closer to 60-40.
If they find that they are 70% at fault and you are 30% at fault, they only pay for 70% of the damage to your vehicle, and may even deduct a further 30% for the damage to the other vehicle.
Also, who says they have insurance? If they don't you get nothing.
If they don't have insurance, there are still ways of getting money off them. Letters of demand are a good start, then after that you can take them to court.
If you have your own insurance, its easier as your insurance company will most likely pay first and then chase up the other person to recover their funds. Let them fight it if you can.
having been through this twice, they pay, but the general insurance rules and limitations apply.
if they dont have insurance thats when your ctp covers you upto a certain amount. If they hit you and there at fault and have insurance then there insurance deems your car a write off or repairs it.

LOL, i actually thought of this in my uni carpark. All on video footage a young p plater was at a stop line and wanted to turn right, pulled out right in front of me. At least i knew ABS kicks in. As i was driving away i thought i could've got a new bumper, headlight and claimed the broken aerial at the time too if i had've let her hit me!Too bad it's natural instinct for me to try and avoid collisions!
sorry let me explain clearer, if you only have third party insurance and the other person is at fault and does not have insurance you can claim upto a certain ammount through your third party e.g gio is upto $5000 or market value.

LOL, you could do that, or if your down in Melbourne out near Melbourne Airport i can give you details on spots that if you follow the road rules will cause a collision (almost 100% guarantee). We have some shocking sections of road.
