Mobile Phone Ban for L and P1 Drivers
From 31 August 2009, all learner's permit and P1 licence holders will be banned from using any type of mobile phone function while driving. The mobile phone ban includes:
- using hands-free mode including Bluetooth technology
- loud speaker operation
- text messaging
- The ban does not restrict the use of a mobile phone when a driver pulls over and parks safely.
- The penalty for using a mobile phone while driving is a fine of $218 and three demerit points.

but the hands free is a bullshit.. pretty sure having a passenger that is talking to you and your talking back to them is the same as using a hands free kit. (which is properly and securely set up before you drive)..
also i'm pretty sure text messaging while driving has been cut down majorly because of touchscreen phones lol..
lol if you have a blue tooth radio, and get a call, how can a cop tell if your talking on the phone or just heading towards crazy..e.g. talking to yourself in the car? ... But I do aggree text messaging should be banned as your looking at the phone to do it, even those touch typists ....
*sigh*, This subject was touched on a while back. tests have actually shown, talking ona mobile whether hands free or not is much more distracting than a passenger. It uses different sections of the brain that tends to remove concentration on other tasks.
Mobile phones should be banned period. They offer nothing to anyone in society. If you want to talk to someone, go see them or wait until in your in a safe enviroment eg: your home to make a call.

I do agree with taking it away from Learner and P1 drivers. These two stages of driving is where a majority of the learning to drive comes from, so by making these distractions illegal and if everyone follows the law there will be less instances of accidents.
However, i can see how sometimes mobile phones are needed while driving (and experienced situations like this), and thus the bluetooth/handsfree is a good option (speakerphone not so much because you still need to accept the call and then switch on speakerphone).
SMSing is a definate no for everyone though.
I agree SMSing should be illegal as well. If something is so important that you can't wait until you get to wherever you are going, or pull over to reply, then it is worth a phone call.
Handsfree I wouldn't have a problem with everyone being able to use though.
Maybe they should ban girls from applying makeup in the car, that would sure make me feel a lot safer in peak hour traffic. Oh wait, that would be sexist because it is directed at women

Well one that general people would find themselves on:
A windy mountain/forest road with little to no emergency lane. Pulling over there could be very dangerous.
It all depends on the road conditions and what can be interpreted as safe, if it's safe then it's best to pull over. If not, the handsfree would be the better option. I geerally pull over to take a call, ive had to deaccelerate from 100km/h and pick a phone up within 15 seconds before, i could do that safely though with the emergency lanes.
Not buying it sorry. Even here in the Adelaide hills, you could find somewhere to pullover to make your call. Its not like the misses ringing you to tell you to pick up milk on the way home is life threatening that you need to know right then.

The freeway. I spend a lot of time on the freeway between Melbourne and Adelaide (well, the freeway only goes to Ballarat-ish), and that is the only time I bother even setting up my handsfree thingo. Any other time I just ignore it and ring back later on. I dont understand how any call can be that important that you HAVE to answer it...
surely if its that important they will call again or you can call them giving you sufficient time to pull over

No room to pull over, and very dangerous spots just to stop.
Picking up a call for milk from the mrs would be stupid in a place like that, but when people could be in danger then it's nessecary. Toolangi and Blackwood State Forest are just examples of where i would consider the handsfree option needed. Both are places where i've had to use handsfree technology to keep groups of up to 50 people safe or locate lost people.

You just answered your own comment. You don't need to answer it. I drove Adelaide to Sydney, and there was plenty of places to pull over to make/answer a phone call.
Alien, why on earth were you looking for 50 people while driving on the road? you weren't going to find them there. UHFs is what would have been a smarter option during a search (which is what the SES use, who conduct searches, so i think your just making crap up)

When the trip is close to 5 hours each way I want to be making the least number of stops possible, so don't want to have to pull over and make/answer phone calls all the time.
There are calls I get that while they may not be life and death situations, as long as it is still legal I would rather not wait 5 hours to hear them
