    Default can you get fined based on a report

    hey everyone,

    out of curiosity, if someone was drifting or sliding however you put it, can a pedestrian or another driver get your number plate etc and inform the police. if so, can the police fine you or even remove demerit points based on a report?

    Dont believe so. They may possible pay you a visit and give you a warning or somesuch.

    I'm in NZ and when I was 15 and on my restricted liscense (same as your P's I believe) I had a cop come and tell my mum her car had been sited doing handbrake slides in a gravel carpark, lol.

    Not too sure about SA, but here in Vic, if there's a statement then yes it's very possible. It all depends on the officer and their discression. Also previous offences can be looked at.

    However, if you submit a false statement and they find out, be prepared to cop a fine over it :P

    Yeah in SA it's possible. A few mates have lost their licences from being caught doing donuts in isolated intersections early hours of the morning. A member of the public dobbed them in, cops caught up with them the next day. They went to court and lost their licence for 6 months.

    my situation, was wet round about, in all honosty my back end slid out accidently, though i was more then happy at the time haha a car was driving towards the round about and drove behind and past me. and also a pedestrian saw me. if anythings comes of what happened i deserve it really need to get it together hahaha

    But its unlikely cops would do that..Al they would do is put a note out to all patrols to watch this car with this plate details.

    your forgetting its sa we're talking about.

    If you were reported then you may get a visit from the police and recieve a warning. But yeah, with crazy carlos on aca you might get used as an example.

    The bottom line is yes, you could get charged for it, but should you end up contesting it in court it wouldn't be hard to shoot down if the only evidence the police had was a single non-police eyewitness.

    In VIC, two of my mates were having some fun of the sideways variety on a gravel road, saw a car coming so drove straight til it passed, then ripped a u turn and traveled back down the road sideways again. Car that passed them was waiting at the end of the street, the driver didn't get their license plates but got some very distinctive details about the cars (Colour, model, particular stickers, particular rims, etc), and dobbed them in. They both lost their licenses.

    If you are paid a visit or receive a fine (or both) you could dispute the matter citing that the 'witness/es' are mistaken or are embellishing the alleged incident possibly as a result of your age or the type of vehicle you drive. Always deny and request proof as you are well within your rights to do so. However, this can be difficult when there are multiple witnesses of good character and community standing.

    i think it only realates to the vehical not the actual driver... but could be wrong there.

    they cant fine you on hearsay UNLESS the observer is a 'on duty' police officer

    You can't fine a car. The fine would go to the registered owner and it would be up to them to submit an alternative driver.

    That is of course if it goes that far.

    Tell that to a mate of mine who did a burnout in front of an off duty cop's house. Next day the vehicle was impounded and mate fined.

    Video wasn't clear enough to tell the number plate, but because it was an officer the next day marked cop car came to my mates place and a tow truck after that. Had photos, they've since been taken off FB though.

    I never said they would fine your car!

    lol In SA they are supost to go on a 3 time reported system.

    after the 3rd time they will either impound the car, defect it, clamp it.

    If you mate was in VIC, its different rules pers state...

    seeing as the thread starte said he was in SA then seems my post would be more valid!

    BUT cops do what they want usually so they could just put you in jail!

    Thats bullshit if you can be done just on someone elses word alone. Its effectively your word against their's. It annoys me even more because if you commit a real crime, like glassing someone in a pub you can get away with a slap on the wrist even with a pile of evidence against you.

    Coppers are always "on duty". All this crap about them not being able to do anything unless they are on duty/in uniform/wearing their hat/making the West Coast Gang Sign is all bullshit. A copper has the same authority whether on duty or off. Most choose not to do anything official while off duty because who wants all that paperwork on your day off?

    had a 'off duty' policeman report me for speeding, i received a infringment letter in the mail, took it the the police station as it stated a policeman witnessed my speeding and i argued it they only gave me a warning as 1. he was off duty 2. no way he could tell what speed i was going.

    NSW law might be different to SA law!

    Might be different in WA too. Over here the uniform just basically identifies them, they have the same power whether on or off duty.

    lol oh well... he just wants to know out of curiosity! so it don’t really matter

    In SA, u get a warning, maybe a 2nd for your second offence, and 3rd they look at the car.

    but saying that, it would have to be like fairly bad reports.

    " he changed lanes with out indication"
    "he was tapping his break lights which blinded me"

    those would probably be dismissed and you would get a warning for all like that.

    when its like

    "he did and massive burnout in the middle of the intersection"
    "he just was speeding and weaving in-between cars and cutting people off"

    they would take them more serious.

    and the police now don’t take anonymous callers, you have to give the correct information in case you have to go to court, this also stops you enemies ringing up and abusing you hell off you.

    also if you have a decent alibi then the warning is dropped.

    two off duty police officers witnessed my mate doing what they said was over 130km/h in a 50 zone, they called him into police station and he admited to it and got 6 months loss of licence and 1700 fine. now he has to sell his car because of it. lol
