    Default Ebay seller not selling

    I put two offers on a car. The first was not accepted but the second was. The seller now doesn't want to sell for that price. Is there anything that can be done? I think someone is offering him more money for it which is why he doesn't want to sell. As far as I am aware we have both entered into a legally binding contract.

    na take it up with ebay, they do help. they have helped me out a fair bit in the past. Just let them know and see how you go .

    What will ebay do? Cancel his account maybe? I'm sure if he is getting more money from someone else for a car he won't give a shit about his ebay account...

    Would you really want the car after you/or Ebay has 'made' him sell it to you..?

    I know I wouldn't... How do you know how he's going to look after it until you pick it up? Thrash it/Take aftermarket parts off it, not to mention just being a dick, if he's willing to 'break ebay rules' what else is he willing to do..?

    IMO, like others have said, just find another car - buy it from someone that isn't dodgey!

    If he put a disclaimer on the listing such as "This vehicle is advertised elsewhere and i have the right to remove this item from sale at any time" then theres nothing u can really do.

    I do remember a case where an ebayer buyer took an ebay seller to court over his refusal to sell his aeroplane I think it was. The buyer had been offered a better price after the ebay sale and would not sell it to the ebayer for his successful bid. The judge ruled that the seller had an obligation to go through with the sale because it was in essence and binding contract and for his refusing to do so he had to compensate the buyer a shitload for screwing him over.

    Well yes thats well and good, so if you have lots of cash and really want to stand your ground go take him to court, but I guess this is not something you will be willing to do so you just need to get over it and find another car. The most you can do is report him to ebay as a non performing seller, he'll get a u been naughty don't do it again email and they wouldn't even go so far as suspend his account.

    Complain to ebay, leave negative feedback and move on, i wouldn't want the car after all the shit that could be done.

    its much cheaper to advertise a car at zero starting big than it is to put 3k on it or a reserve. then you just cancel the sale at the last minute if you dont get your price. you dont need a disclaimer, so the winning bidder get pissed, so what? the sale has been cancelled and as they didnt 'win' the car they cant leave neg feedback.

    win/win for the seller. as everyone else said. look for another car.

    I am actually curious about why people buy a car off Ebay. When I buy a car I like to have a test drive and if it was second hand, to have a vehicle inspection. Surely one runs a huge risk bidding for a car that could be a massive pile of pooh that you haven't even taken for a run around the block. You would have no comeback or warranty and be left out of pocket.

    I've bought a car from ebay, I was concerned about the things you mentioned but there are ways to cover yourself, go and see the car and take it for a test drive before purchasing or what I did was sign up with a new ebay account and bid and then go out to get the car but thouroughly inspected it and test drove it before handing any cash over. I covered my arse with a second account because I could have walked away from the transaction at any point and whats the worst they could do, report me as a non paying bidder and have ebay suspend me? not like I would have cared when I have another perfectly good account

    I bought mine off eBay! It was listed on carsales too, but eBay price was much cheaper, didn't reach reserve first time, second time he wanted to get rid of it, price went up a little from the last auction and i won. I did a check through the NSW Road Authority to make sure it had never been in a collision or on finance. Asked the seller if it had any problems, only thing was stated was a small scratch in the drivers side paintwork. Bit of touchup paint fixed it. But because there was no mention of any engine problems or anything if i was to incur costs of $1000 or more to repair major things it would be covered by eBays Vehicle Protection Program.

    Great bit of insurance which is automatically included on many vehicles. Pretty much all it needed was rocker cover gaskets redone anyways and a new tyre. Ebay seller was nice too, when i got there to pick it up he let me take it for a spin to make sure i was happy.

    Went really well.... except i forgot to leave him some good rep! :O

    Cheers for the replies Julie and alien. I guess I was thinking more of cars interstate where you can't test drive them.

    Obviously having never looked at purchasing a car off Ebay, I wasn't aware of the purchase protection program.

    I bought my car from Vic off eaby. Wasn't actually am auction tho, it didn't meet his buy it now price, so i emailed him and asked what he wanted, then went over and test drove it myself

    I bought my VH from ebay as well, didn't even test drive it, or when i went to pick it up i didn't even get him to start it! And it turned out to be in very good condition ones i got it towed home. Gearbox was rebuilt (he didn't even know anyway) engine in good running order, hardly any rust. I've trusted him. But not going to do that again in the future

    Was the reserve met? If not then it is at the sellers discretion as to whether or not they let the item go for a lower price.
