    Default Car accident question/advice

    Hey guys,

    In a little of a dilemma. Was involved in a car accident over the weekend. It goes like this, i was parked at the curb, and was leaving, checked my mirrors and blind spot and proceeded to pull out of the space, i was pretty much 90% out when all of a sudden i hear a screeching noise and feel a little bit of a bump, this lady hit me but when i jumped out to see what happened i didnt have any damage to my car. On her car she had a large dent with wite paint (my car is white) on the top of her front passagnger guard. We exchanged details and i explained to her that i cant see how that damage was done from my car when i obviously dont have any damage to my car (BTW her car was dark green). Now she is chasing me to get it fixed. I did however notice after that that my rear drivers wheen had a large scrach on one of the spokes.

    In a situation like this when i have come out of a parking space 95% and in the lane, who would be at fault? seeing as there is no damage to my vehicle im not too worried, but just want to now your thoughts on what i should do....

    You were pulling into traffic... you're at fault.
    Sorry, but I've been hit 3 times from people doing exactly as you have done. No excuses for not checking properly...
    I just love the way other motorists on the highway think it's an unmarked cop car.........

    so she hit the back of your car, wouldnt that mean shes at fault. tough to determine.

    call up your insurance company and give them the details, see what they think rather than have 100 people here guess whos in the right / wrong

    ye she hit me, i did check properly i was pretty much out of the space ond in the lane, SHE HIT ME on the rear wheel as i was straightening up... if we collided at the front end or even in the middle of the car i would take responsibility for it...

    I rang insurance and they said that its hard to determine, but seeing as i was in drive moving forward and in the lane it could be her fault, and also my exceess is $2k her damage id less than that so my insurance said they wont take it on as the damage is less than my excess... i dont mind paying her for the damage but i honestly dont think im at fault seeing as she hit me from the rear...

    Technically you're joining the line of traffic, so wouldnt the same rules apply as to if you were changing lanes; giveway to all traffic currently in that lane?

    i see wat ur saying but i didnt hit her it was the otherway around, i was already in the lane

    basically if she hit u in the rear then she is at fualt.. doesnt relly matter wat circumstances are normally always if u get hit in the rear they are at fualt.

    It sounds to me like she hit you on the side. I think its pretty hard to rear-end you and only scratch a rim. Sorry mate but it sounds like you are at fault. Until you are fully straight in that lane then you are still 'pulling out'.

    I would say you are mostly in the fault if you are still pulling out when she hit you. However the Insurance companies will nut this out, and will apportion a bit of blame to each of you more than likely.

    she got a quote its $800 to fix it my excess is $2k so my insurance said they wont bother cause its not worth more than my excess

    This is easy,you pulled out,you hit her and its your fault.
    You are lucky there is only minimal damage,id just cop it on the chin and pay up.

    But she only made contact with you because you pulled out in front of her...

    The way I see it you are at fault.

    Don't know that your analogy fits your desired conclusion.. It seems she was the fist driving down the street that punched him.

    I have no idea who's really in the wrong but if someone was out far enough into the road that I hit their back wheel then I wasn't paying attention to the road in front of me.

    edit: Was it a wide or double carriageway road?

    Anyways I've told her to go through insurace well see how that goes also turns out it was her friends car not hers and she only has a uk drivers licence so might work out in my favour cause she should have a international licence right?

    out of curiousity what was the speed limit of the road you pulled out onto? And your most likely to blame unless you have the sign on your car a bus has . But you never know if she changed lanes or just pulled or hersefl.

    Need more info really

    Speed limit was 50 one lane each way... I can see y most people are saying that cause I was pulling out I should be more careful but wat if I was pulled out 90% like u was and there was traffic in front of me and I couldn't go much further how would that be my fault that's wat I don't get if I'm that far out I should by that stage have right of way that's just the way I c it... Oh well I guess I'll find out soon if she puts a claim through insurance

    Yeah very hard to call being a 50 zone and if there was a car that close mmm she really should b paying attention. I mean you should always be driving defensively or as i call it everyone else on the road is a idiot and except anything.

    Really it comes down to what you think, if you really don't think your in the wrong then i wouldn't pay it.
