Hey guys i need some advice on an issue i have. I got done speeding (doing 45 in a 40 zone at 3:55pm) through a school zone and jsut got the letter then saying im losing my license for 3 months.
Is there any chance that i could put forward an appeal on the grounds that i need my car for my job? Im a fitter/machining apprentice and my job requires me to travel around the sydney area with my huge toolbox. Pretty much i cant drive i cant work. Not to mention that im my wifes ride home from work at 10pm through out the week.
I know i got done and i accept i made a mistake, but what are my odds in winning an appeal and say getting a good behaviour bond or something instead?

You should be able to be granted a 1 year good behaviour bond (no demerit points for 12 months or you lose your license for 6 months). However, thats in Victoria, you should check up on the NRMA or whatever the NSW equivalent of VicRoads is...RTA or whatever.
Losing your license for 3 months for doing 5 over, regardless of a school zone is an absolute shit deal. I don't agree with it.
Yeah any kind of speeding fine for P platers in NSW is just a full on 3 month suspension. Probably not good that it was during school hours but honestly i was 5mins shy. Either going to have to appeal it or just wear it and try and weld up a toolbox on wheels to attach to my pushbike![]()
Speeding penalties
harsh, 5 points for upto 10ks over in a school zone, which from what i can see goes til 4pm. best sync your watch next time. with those sort of points, even do the zone limit for 5-10 minutes outside of the times just to be safe.
id suggest looking at the site, or calling the rta, see what your chances are.
seems harsh considering i got the same penalty for going 30km/h over..

as TVR said mate, the SDRO only look kindly upon people who have had a clean record for the last ten years, in this case they are willing to let you off a speedcamera fine etc. There is zero tolerance for school zones as a fully licensed family friend got done in a school zone with a 20+ year driving record, the SDRO wouldnt budge.
Apply for a workers licence not sure if they have them where you are but they have them here. Means you can only drive in certain hours.
Depending on the rules over there you could appeal and get it back with 1 point for a year but if you do anything wrong you will loose it for probably 6 month to a year.
So weigh it up carefully cause if you get done again and loose it for a year you wont be able to appeal that.
I rang up the local court house today and told them how its my first offence and my situation with work and that, and she told me to get a letter from work and as well as the people who taught me during my L's and the tradesmen i drive around for work saying im that im a good driver and it was an honest mistake. Apparently my local court sees good on people putting forward appeals for some reason to do with work, looks commited i guess? Having a government apprenticeship i spose would help as well?

Yeah, you can elect to have it heard in court, where you can plead guilty to the offence, but explain to the magistrate your situation and hope they give you some leniency with the punishment. If you're not obviously a cockhead, and you get a reasonable magistrate I think your chances are probably decent - given it's only a small amount over, and hopefully your first offence?

i had a close friend that got done for the same thing,
he was a mechanic at the time, and with some witnesses the judge granted him a 6 month good behaviour bond.

School zone you'll have very little chance of getting it but it doesnt hurt to write a letter to them..
Dont say that you were not paying attention, they'll hate that.
just say that you didnt realise that you were doing that speed and were focusing on the surrounds as there were quite a few kiddies around, or that your speedo was a bit out as well, as far as i know you are allowed to have a speedo that is +/- 10% out.
Hey guys i went all good and was told to do the traffic offenders program and come back on the 2nd of August. Ive recently heard about the "Defence of Honest and Reasonable Mistake of Belief" and i thought this might apply. Anyone have any information on how this might go?
Just a little update, went back to court today and got the suspension down to 4 weeks

Good to hear, the offences this country has for speeding a ####ing joke. You can beat someone within inches of death and walk away with a slap on the wrist. Do 45 in a 40 zone and your made an example of...absolute joke.
