    Default Speeding fine :(

    Ok before i get flamed yes its a tread about me getting a speeding fine

    Now i will admit i do speed every now and then , but the other day i got a fine in the mail for going 60 in 50 area from a mobile speed camera . But the thing i s could have sworn that the sign said 60 .

    I drive along this road all the time to and from work. So i went there the the other day to check the sign and sure enough it said 60 so . I got out and went to take a photo of the sign to prove my point . And i saw that the sign had been altered with a black pen or something changing the 50 to a 60 .

    Do I have any way at all to fight this or is it a whole case of "you shouldnt be that dumb and know that the speed limit should have been 50".

    Now the road is part of a main road that the speed limit is 60 and this road i got caught on is the same size and that so it doesnt look like a typical 50ish speed limit road that leads to a crt or what not

    If i do have a chance of getting out of this , who would i talk to or send a letter too

    haha you went and painted the sign didn't ya, then took the photo
    i'd fight it in court.

    or see the head honcho copper, what ever there called, they can cancel a fine (in qld anyway) i had to see him to get out of a 6 mth suspension and a court for driving on suspended license, cause sper stuffed up and suspended my license for no real reason. i got out of it all after i got sper to admit they stuffed up

    My advice, from past experience many moons ago is; If you intend fighting the charge, then do not do it alone, you need representation. The Magistrate/Prosecutor will tear you to shreds, unless of course you have some kind of training in the law.

    damn i thought you could just write a letter in or something along those lines like when you get a train fine kinda thing.

    bummer i got caught doin 60 in a 50 zone aswell didnt mean it either mate.. but i just paid tha fine no point of fighting a batle ur just gonna lose.. we sped and that was it lol

    similiar thing happend to me mate, but they were changing the speed limit from 60-50 but had only done one side so far and it happend to be the side i was on, couple of weeks later i get a fine in the mail for 62kms detected and 59kms alleged speed. so i wrote in and explained and they sent me one back saying basically thats no excuse and that i should have been a f**king mind reader and known they were droppin the speed, so i went to court after about 4-5months and the police officer who set the speed camaras where they sit didnt turn up soo case got thrown out and fine cancelled

    Definately fill in the form explaining that the sign was defaced and unable to be read correctly, then it will go to court in several months at which point you should see legal aid who will help you out a little and represent you. They will probably say to plead guilty but the magistrate should be nice to you if you have don't have any convictions. Possible outcome is not having to pay the fine but still getting the demerit point. Whole process will probably take around 3 to 6 months. But will be worth it if you really want to fight it.

    Fight it, its misleading. Dunno bout where your from, but here when you get a fine you can simply write to the chief bloke of some department contesting the fine, then he will say yay or nay. Furthur from that is probably civil action..

    in Qld there is a mailing address where you can send a letter contesting the ticket.
    send a letter with the photo explaining the situation. Often if there is a legitimate reason given, minor offenses like this won't even make it to court. Prosecutions will sometimes just choose to waive the ticket.

    Not sure if the same applies in Vic though

    i got off one in vic... got caught doing like 57 in a 50 zone by a speed camera car parked on the side of the road... just wrote in saying yes it was me, but i havent had any sort of fine for years, and request a warning only ect. then got a letter in the mail a few weeks later saying that i dont have to pay anything and no points were taken.

    As others have said, send a letter with a picture of the sign and the area that you were caught in, you maybe lucky. If they don't let you off, I would spend the money and take it to court. Make sure that you have a legal eagle to represent you, as the prosecution can be a bit intimidating if you have no experience with the legal system.

    It is very nerve wracking to go to court if you have never been, and trying to remember everything you are meant to do. I spent HOURS learning about the court system and what I had to do for traffic offenses, and still had issues. Talk to legal aid who can represent you for free as I don't think paying a lawyer is worth a 10kmh over fine, unless it's just the principal of the matter.

    You have every right to try and contest it, through a letter.

    Write a letter to the Traffic Camera office, which the address should be on the infringement notice, write a professional business letter style, with the photo of the sign, detailing your situation and yeah. Give them the exact address of where the 'tampered' sign is and they will investigate. FIGHT IT OUT!

    In victoria you and write to civic compliance and request a warning, I think you get one warning every 2 years sometimes they'll give it to you, I just got out of a similar one (75 in 70 zone) but anything else you'll have to fight in court.

    Id like more info on fighting fines in court too (victoria) if anyone knows, or what to do. I wrote in about one fine and in the reply they said it could be up to 2km/h wrong + or -, so what I want is the alleged speed reduced by 1/kmh which will make it from 3 demerit points to 1 what are the chances lol

    address should be on the form mate, good luck with it! make sure you go into detail maybe attach a letter with the photo of the sign, explain everything and send that with the form etc.

    I wish they didn't have quoata's to fill.

    I wish the people employed to sit in a mobile speed camera got a decent job where their sole purposes wasn't to make people miserable for being 7km's over the limit.

    I wish that a lot of the signs on freeways were variables so the stupid ones (Like 80 on the Caldar Fwy) were 100 at 3am in the morning when there's only one car on it.

    Wishing is great but it really won't help.

    Fight it dude, make sure the magister understands that you've been doing 60 there for ages and no one has ever pulled you up, mention cops go 60 along there and if possible find a copper that does go 60 and get a testamony. It's anyones mistake to think that Signs on the road are properly maintained and not defaced and if anyone should be blamed it's Vic Roads/State Government for not maintaining our roads and as de facto the signs associated with them - a.k.a. negligence.

    Gl, keep up update; oh and.. get a solicitor 3 months before you go to court
