    Question Reporting a Hoon in WA

    I was driving in standstill traffic getting out of the CBD this evening. A taxi driver tried to force his way into my lane from a car bay and nearly hit me. I of course yelled at him and he began to behave showing violent gestures and started screaming also. He followed me (I guess he was going the same direction) and at the next lights even taunted me to pull over (he may have been after a fight).

    I saw him get a notepad in my rear-view and though he's taking down my licence.

    Now, what can he do with my licence details? The only thing I can think of is that he could try to report me as a hoon. I know the police site says you can report a hoon just by;
    *description of behaviour, eg: speeding, drag racing, burnouts, etc
    *description of driver
    *day and time of behaviour
    *location of behaviour
    *vehicle registration
    *vehicle make, model
    *vehicle colour

    It dawned on me, anyone can make something up if they hold a grudge against someone. I of course was not hooning, it was stand still traffic, nor have I even had a fine in the last 3-5 years for anything because I do my up-most to obey traffic laws.. But what if he decides to make something up like I was doing a burn out etc.

    What would the cops do if he did report me?

    Also, has anyone ever been reported and convicted of hooning wrongfully?

    And you didn't think of taking his rego? What would police do if he does make a complaint, nothing, why because there is no proof.

    I'm not against taxi drivers. I catch taxi's for work quite often and most of them are nice guys. I actually might be the type who would enjoy doing it (but not at night). But some of them just cut you off and think they are a bus to give way to. This is not the first time its happened. I'm sure most of us have experienced it. This fella was centimetres away from hitting me. I was taking to my wife, looking at the car straight ahead and next thing I knew was a taxi almost hitting me. He tried to push his way in. Maybe I could have stopped to let him in, but I wanted to catch the light up ahead. I maybe should not have yelled out the d-head word but it was a reaction. When he passed me further down I even waved apologetically, to be nice, but he just gave me rude signals. I usually drive with courtesy but this time I didn't let in one car and hell breaks loose.

    Why do you feel he is going to report you for hooning?

    Maybe you should call the cab company he works for and put in a complaint about this ********, tell them that you are going to report him to the police aswell.

    Oh, its just that I saw him do what looked like take my licence down. So I thought what else could he do with it? I think I posted this before; months ago I pulled into petrol station a bit fast (but no way exceeding the road 50km speed limit). The petrol station attendant threatened that he could report anyone for hooning around if he wanted to and there was nothing anyone can do. This petrol station fella seamed like a want-to-be cop who works selling cigarettes and fuel. So thats what I though this taxi driver may do...

    I did think about calling the cab company yet I am not really the kind of person to hold a grudge and give people the benefit of the doubt. Perhaps the chap had a crap day etc. But if I did call the cops, what the heck can I do? I wouldn't lie and he didn't hit me after all.

    If he calls the cops and says u were being a hoon then the cops might charge you..but the only way they will do that is if the cabbie is willing to testify in court to exactly what it is that was a hoon offence.

    Will have to remember everything that he told thecops down to the exact detail. All you will need to do is supply 1 witness or obtain the video that is always on the freeway to show it is a load is crap.

    In other words i wouldnt stress about it. People will always act tough n say they will get you hoon lawed but then once they know they will have to stand up in court to testify to it exactly they bitch out usually.

    Well my wife was in the car. It wasn't on the freeway, was in the CBD in Perth.

    btw there are a hell of alot of camera's in the cbd just to let u know :P

    Yeh, nothing will probably happen. But it just gets you thinking how easy it is to be branded a hoon in this state. More like guilty until proven innocent. Even the police need to have camera evidence when they catch you speeding. But under the hoon legislation they seam to be obligated to charge anyone.

    I'm not saying you have to actually call the cops, just say to the cab company you will/might. It's scare tactics and in this situation it would work, the cab company will have a word to this guy then.

    Even if he's had a $hit day it does not excuse his behavior, look even if he had a bad day it does not mean you should not follow up on this guy, you said he possibly looked like he wanted to get into a fight what if he does this to somebody else and they stop.

    People like this should get put in there place.

    Mate, you have nothing to worry about, you did nothing wrong, and if they say you did, say prove it?
    I had a similar thing happen last week.
    Was driving around a corner, and took the corner decently fast (not above the speed limit, but didnt slow down too much and accellerated out of the corner). There was a middle aged lady (35ish) crossing the street in the middle of the road, I continued at the same speed and she kept walking across just looking at me. When I passed her there was a bit over a meter between me and her.. As I was driving away she was gesturing at me, then squinted to look at my plate, pulls out her phone and makes a phonecall, continueing to stare at me.
    I was worried at first, then realised, I hadn't done anything wrong, and she was jaywalking.

    Very well said and very very true. You will be fine mate. Oldies will do this as well but do you think they will go to court?? I've had some bitch dob me in for spinning the wheels in the wet and the cops called me up saying they have a witness and you may be charged and have to go to court rar rar.... I said basically righto bring it on... If anything mate they will give you a call and try to scare you but nothing will go ahead unless it was a bad form of 'reckless driving' and almost injuring someone then they may show up in court to testify etc...

    I'd be keen to meet this taxi driver if he was able to get your license details from behind you, in another car, while your license was most likely in your wallet, in your pocket! That's seriously impressive!

    To the OP, her ein Vic the police report you. Ive been reported twice now and in both cases I knew it was going to happen, so I made sure i remembered rego, car, driver appearance etc. One case I overtook an old fart doing 30 in a 60 zone. When the police come to visit apparently i had my tyres smoking going sideways. 2nd occassion I was tailgating, had a (what i thought) drunk driver in front of me, was driving in a 60 zone, he would go from 20 to 60 and anchor on brakes all while over the road. Hard to not end up tailgating when someone keeps stopping in the middle of road. Turns out the guy is an alco and was caught drink driving later on.

    I wouldnt worry about it, if it ever got to court they person reporting it would have to appear and have a pretty credible story with evidence.

    As a general rule police need to observe the alleged offenders manner of driving in order to take action. That said if people come forward and wish to lodge a complaint action can be taken based on witness statements. In this case its one persons word against another so its highly unlikely anything will happen. Matt

    HAHA, yeah gotta watch out when your overtaking, those sideways actions can creep up on ya.

    I had some idiot yell out 'HOON' to me one day, I mean I'm a young male in a Commodore with a loud exhaust, and fairly decent stereo (which was down at the time), but people seriously need to work on thier timing. Calling me a hoon while going past me at 10-15km/h over the speed limit is a little off. BTW I had cruise control on and was perfectly doing the speed limit.

    I understand and agree with bus drivers pulling out and making you wait for them. BUT Taxi drivers here in perth are absolute A/H's iv had that before and nearly hitting me. I also had a car load of guys who weren't exactly sober but that didnt mean anything.. after we got to the traffic lights i rocked up next to him with no dirty looks nor abuse. and yet he was giving us./me dirtys? WTF right so my mate in the passanger said "hey buddy, no need for the dirtys - your the a/h that nearly hit us" and he goes off at us saying we were speeding and we are hoons and if we werent going so fast 15kmh roll stop there wouldnt of been any problems and do you make threats to me i will dob you in to the police you hoon! and i was like seriously buddy.. 1 car full of blokes and you wanna start flappen ur gums with lies.. ha!.
    we also were rolling up to a set of red lights.. ha! its all about the look of your car you got a done up car instantly people think different of you and think ur a hoon i hate it. i always drive properly and obay the rules.

    I think taxi drivers are the biggets hoons out of all of us!!!! seriously go down orrong road at like 12am on a sat night speed limit 70.. Taxi speed limit 110

    No point calling the company, its pointless. I have done it 3 times to no avail, and I don't have anything against cabbies, my dad is the manager of a company.

    I was on my way home from a cruise with 2 other cars and this same cab cut me off 3 times within 4kms, YEP 3 times! I have no idea what he was trying to do, but i had to slam the brakes on 2 of those 3 times, and the 3rd time he was pretty darn close. So we all happen to take the same exit off the freeway, 2 of us in the right hand turning lane, 1 behind the cab. A passenger of mine called the guys in front, who then called the mate behind the cab and we blocked him in and slowed down to 20kms p/h for about 15-20 minutes. Bully tactic's I know, but bugger him! Bet it taught him a lesson to not be in such a hurry.

    Unfortunately in WA the laws have been changed for the public to call in what they believe to be a "hoon". Weather you did it or not, you have been dobbed in and you have to waste not only your time, but the coppers time that have to come out and investigate the report, and then you have to sit there and try to plead your innocense, all because some asshole that did the wrong thing in the first place thinks his/her shit don't stink.

    you will be inconvenienced if the report is made, and if that person that made the report is angry enough to try and follow it thru..........i'm sorry dude, but you're gunna have a fight on your hands to prove your innocence.

    As far as Cabbies are concerned, make the repot, and write down the time and date you rung. if nothing has happened, you have every right to go to ACA or the newspaper and publicly tell everyone what has happened. they will soon pick up their game.....they will have no choice in the matter
