Life for street racing STREET racers face possible life imprisonment following a state government decision to make drag racing a criminal rather than Road Traffic offence.
Hoons caught street racing face a maximum of three years in prison and a one-year loss of licence.
Road Safety Minister Jack Snelling said the changes mean a subsequent street racing offence would attract a maximum penalty of five years jail and a minimum loss of licence for three years. An offender causing death or serious harm street racing would now face a maximum penalty of life imprisonment.

Kill someone and get charged with manslaughter (which is what essentially hitting someone and killing someone in a car is) and you'd be unlucky to see the inside of prison for more than 5 years if you're on your best behavior.
Its just going to be stupid when they get some poor bloke with a nice Monaro or something seen as a hoon car, hes doing 100 in an 80 zone and he hits someone. They claim he was hooning and all of a sudden hes potentially facing life in jail for what is usually around 5-7 years if you got into a drunken brawl with him and stabbed him.

It should apply to anyone who kills a person. Full stop end of story. I dont see the difference between the situation in Melbourne at the moment where everyone and his dog are carrying knives around the city (or so we are lead to believe). I dont see why one of these dropkicks dont deserve life in prison whereas some guy who used a car instead of a knife/gun/broken beer bottle.

amen to that! the laws here in the western world are ridiculous. if a couple of scumbags break into your house and threaten your family, they have more rights than you do. if you stabbed on of them to defend your family you would go to prison for attempted murder whilst the burglars get a slap on the wrist. its messed up

a person can legally kill another person when they are being threatened with death.
if a person comes into your house you have the right to ask for id if they refuse you ask them to leave(inclosed lands act 1901).. if they refuse you can touch them if they resist you can fight then (weapon less conduct) if they grab say a knife or baseball bat or something and threaten you, you can kill them without any repercussions besides guilt.

hmmmm a friend of mine is a lawyer and we were discussing this a while ago, and he said when it comes to defending your property (family included) you are within your rights to take reasonable force of action, i.e. you could knock them out cold and tie them up until the police arrive but not kill them. i suppose if its a kill or be killed sort of situation no jury is really going to convict you because anybody in the same situation would do the same thing
Yeah its reasonable force.
For example if a male adult has broken into your home and is threatening you with a baseball bat. If you are a adult male it would be unreasonable to pull a gun on them and you would be charged. However you can use a similar force, ie cricket bat, perhaps even a knife.
But it also comes down to perceived threat. If you can convince the court that you were in belief you were going to die you would probably get away with it.
This is the bit that gets me though, say someone comes into your house to attack you, you pull a gun and he says time out you can't pull a gun I only have a baseball bat, You say sorry mate that isn't a fair fight, he says no worries, just grab something else I will wait here, you go out to the shed get the bat, come back to him and say game on? As if.
My way of thinking is you would do anything to defend the threat on instinct, I am not going to sit there and assess a threat level when I know my family is next, I am gunna just try and take that person down.
