Default backyard skid pad, legal or illegal?

    Hey guys,
I am looking at putting a skidpad in my backyard for legal personal use and use for friends and the like. Im just wondering if this is legal and what not. Would look at a fairly big one somewhere in the range of around 20m x 20m. Is it also legal to charge a fee to allow others to use it? I.e. have a few mates around put on a barbie and some beers and charge say $10 entry towards the cost and maintenance?

It would be illegal to charge a fee without registering an ABN, and you would be charged with noise/smoke pollution if a cop rocked up. You'd need permission from govco to get away with it, I would think. I'd go with a smaller pad and a shed, drainage on the outside so you can work on the car even if it's raining

Its legal unless someone complains about noise or smoke. Also can't drink and do burnouts in backyard either.

Its prob not legal to charge your mates but i doubt anyone will tell anyone!

    EDIT - beaten to it

Fairly sure in residential areas it is not allowed.

For it to be allowed in industrial areas you would require all sorts of insurances, permits etc and it would have to be a wet skid pan.

I would say that you would have have heaps of problems with your insurance company, neighbours, Police, Council (using land for purpose not zoned accordingly)etc. You would need to have liability insurance specifically for motor-sport, you would most probably also have to comply with Occupational health & Safety provisions etc. Think you best get yourself a very good lawyer. Hope you've got lots of money. It might become expensive.

I reckon it depends on the size of your backyard... like if it was in a typical surburban street then hell no, however if you had a few acres or such you might have more chances of getting away with it. I don't think anyone would mind you asking for a bit of cash if they came round and used the pad.

The question is not whether anyone would mind, it's whether or not it is legal. For the noise/smoke pollution issue, if he is likely to be charged for this on his own skid pan, there's no point in doing it in the first place. May as well do it on the streets

You would be shut down faster than you opened. I doubt you would be able to cover the cost of insuring this, and you would need insurance. Imagine one of your half cut mates losing control killing/hurting one or more bystanders. You would be charged and probably sued. As already pointed out, you start charging people then you are classed as being in business, therefore need to register for an ABN and keep a record of your income etc for taxation purposes, even if you could find someone to insure this venture and you can afford the premiums.

Pretty sure you would need a building permit and probably planning approval from your council as you are significantly changing the covered area of your land. If you charge for it's use you would also need council approval to carry out a commercial enterprise on a residential zoned block of land.

You would also be obligated to provide adequate fencing capable of catching an out of control car, along with public liability insurance and the like. All in all you might find it somewhat expensive.

Btw - do you have any idea how much 400m2 of concrete pad actually costs???

Yeah, not entirely sure on cost, but was thinking something along the lines of about $150 a cubic metre as a guess? But it sounds like there is a lot more to it than just putting a slab down. Stupid red tape.

Actually, my understanding is that in this case, the red tape is there to avoid the stupid.

But yeah, you would need a permit for a construction like this, and if it's in or near a residential areas I don't see approvae being given for putting down a concrete slab for the purpose of a skid pad.

And if you got a permit for putting the slab in by saying you've going to use it for something else, then you would get the boys in blue turn up when the neighbours, passer by, etc complained about the noise and smoke.

No, what it does is it stops the stupid killing themselves in their own back yards and then they do it on the street killing someone else.

Stupid people are going to do stupid things no matter what, at least allow them to do it at home away from the general public.

lol its all fun and games until someone goes through the fence or house ... if you just had a slab and ripped skids yourself i dont think you would get much trouble.. but if u start charging ya mates it will all turn to poop id say.. and its only gonna take some dog mate to hurt themselfs or there car and try and sue you..
