you shouldnt rely on your mate to tell you how to drive.. and what you did was dangerous hence why you recieved a penalty notice.
So this was at a pedestrian x-ing? Here (nsw) they flash amber after for about 5 seconds after the pedestrans x-ing time has finished.
Everyone just drives through the Amber lights. We obviously start with the green, amber, red then the people cross.... After
the 15 seconds or so that allows them to cross they get the red "no crossing" sign and we get flashing amber lights where we
start to take off then it will go green.. I always just take off in the amber lights as I was under the impresion it was just
signaling caution to a lagging persestrian or something.... hmmmm? I didnt think it was illigal to drive through an Amber light?
304 im not sure if its illegal but i do the same thing and drive through the amber lol
but the OP said boom gates... im assuming railway boom gates?
First, wait and see if you get a fine. Then see what they got you for. If its anything like a red light camera then the fine might include how many seconds early you went. If its stuff all like 0.8s i would write a polite intelligent letter and see what happens. In vic if you have a clean record for 3 years quite often a minor infringment will get downgraded to a notice of caution if you write a letter and contest it.
Having said that you are on probation. The whole idea is to stop you from taking rules for granted and getting into bad habbits. I run red lights when appropriate and drive 10km/h over on highways but I didnt when I was down to 1 demerit point when I was 18, I only do it now that I havn't been booked for 6 years
Boom gates sounds like a rail crossing to me, too.
Tough luck. I'd say you should be looking before you start moving, for one thing. Good luck getting $200 out of your mate thoughDo they do the same thing in WA as they do in QLD, where you can choose either 3 months suspension or 1yr good behaviour?
Mate you were distracted for a start. Learn to pay a bit more attention on the road. Cop it on the chin and move on.

yeah it was railway crossing, and it was right before the lights went off like as soon as i moved onto the tracks the lights turned off
and we do have the 1 year good behaviour but not for p platers, i will just man up and cop it on the chin if i dont have to go through the full year of learners again, if its only wait 3 months then resit the test and i get my license straight away then whatever thats cool but if its 3 months then the full year of learners no way am i doing that

You will get your P plates back. I have yet to hear of some one redoing their L's.
Welcome to the internet where people have opinions that you might not like
ah ok, yeah I wasnt sure if "boom gates" was WA slang for traffic lights or something...lol... We dont have many level rail x-ings where I live... But yeah, like most of the boys said, just cop it on the chin.
you will just wait 3 months and on the day your due to get it back you just start driving again.. unless a copper takes yours off you, you have to get a new one
i have 3 weeks left of my 3 months suspension and it sucks balls!!! so enjoy :P
yeah a mate was saying you gotta go through your l's again which i didnt think was true
but i dont know what its like over there but here if you get suspended on your p's they cancel your license and after the suspension you gotta apply for a new license and resit the theory and driving test apparently which is bullshit
ahh lucky bastard haha yeah im sure itll be the best 3 months of my life![]()

hell yeah.. 3 months there would be hectic. then come back and start driving![]()
hahah yeah would be sweet, either that or just planning on spending fuel money on alco and being drunk the whole 3 months, either way wont be too bad

I hate it when people just say yeah you just gotta cop it on the chin but when its them getting done they'll do anything to get out of it themselves. No one is gonna take losing their licence lightly so you just cant tell em to get over it

when i lost my licence i copped it on the chin even though i new it was gonna suck balls! it was my fault.. i shouldnt have been speeding but i was so i decided to man up and cop the consequences
Like wise. When I got done and lost my licence I knew I was in the wrong so copped it. OP's friends sound like real winners.

What if your mate said this and was joking and there was actually a train coming? You do not deserve to have a licence to just take off without looking. So bloody stupid.
Man up? I would say Grow up is the best line to use in this scenario.
No wonder so many younger people are dying on our roads, zero concentration and listening to a passenger while not actually looking. Smart move.

Nail on the head their minux.

Yeah Im going to agree with Minux. You really shouldnt be on our roads if you are relying on your mates for ques when a rail crossing is clear.
if you didnt hit the boom gates then obviously they were not there so if they wernt there and had gone back up then obviously is was safe to cross. so therefore id say thats grounds to fight it on
Safe or not, he disobeyed the lights. The signs say not to cross when lights are flashing, and he did. Good luck.
