    Default Fair or unfair

    Computer glitch to hit thousands of disqualified motorists | Adelaide Now

    Seems anyone who asked to pay fines off in instalments that should have had their licence disqualified at that time were not notified due to a computer glitch.... in 2009.

    During a recent audit they noticed the error and are now sending out thousands of letters to SA motorists affected saying they face loss of licence.

    Unfair. QLD transport did this to me. Went in asked how many point's I accrued. Reply back was 12. Told the lady err doesn't that mean no licence? Response was oh some times the letters get lost in the mail count your self lucky.

    Fair- I reckon most of them would have known that they *should* have lost licence and they caught a lucky break and thought they got away with it. Sucked in, they broke the rules more than once and now they get the punishment albeit later than they should, better late than never.

    I think it's unfair they didn't sort their sh-t out sooner (Transport, that is) but I think the people who were supposed to lose their license should get a lesser penalty due to the time taken. Then again, you do the crime you do the time, as they say.

    I think it's unfair, most of them would have had there licence back by now if they did lose it back then.
    That's quite a #### up really and to notice it 2-3years later is just poor. I think this time they count their loses.

    The problem with this is that letter or no letter, you were unlicensed.

    You certainly were lucky... lucky you didn't get done driving unlicensed... and was that your fault? Losing your license.. yes of course.

    Driving unlicensed because you didn't know.. of course not, if the last of your points was lost on a camera you didn't see and its taken a month for them to send you a speeding fine (or you haven't received one at all).

    Pretty rare for mail to disappear these days, that's usually a copout from either sender or receiver... so if you didn't receive it, its very likely they didn't send it.

    Wouldn't have helped you in court though.

    Unfair.

    Fair. Either way they are to spend time without their license why does it matter if its now or then.
    If given the choice most probly would have said "I choose to lose it in 2 years time not now."

    give it a month and watch SA scream about how their public transport system is overcrowded, due to the extra 8000 people needing to find a way to get around all of a sudden.

    peoples life situations can change drastically in 2 years, id be giving everyone reduced infringements, fixing the error and moving on. if people didnt learn their lesson and counted themselves lucky, im sure theyll not be far from losing their licence, if theyre not currently suspended already.

    Default [South Australia]They want to disqualificate my license now of what I did in 2009

    Hi Guys,


    South Australia.

    I got my P1 license in June , 2009
    Caught speeding on spot fine of exceeding 10 km of speed limit in Oct,2009

    Them I applied to the court , application for relief. Paid the fines by instalment.

    After that, I didn't receive any letter says I am disqualified because I breach the P condition of exceeding 10km of speed limit.

    Feb,2011 I got my P2.

    On 17 Augest, 2011, 2 weeks later, I am eligible to apply for full license.


    I received the letter says you are going to be disqualified in 28 days for 6 months ,TODAY

    what am I gonna do now? Can I appeal against the disqualification?

    It was like 2 years ago, if I served the disqualificaion now, (disqualification of P1), I would have to wait another 2 years to get my Full license.(My assumption)

    Please any help.

    I'd ring the transport office and see what they reckon. Did you get something saying you're going to be disqualified? If not then I wouldn't worry about it, and just go for your license.

    You can appeal but if you read the article above you will find they are not backing down on this, specifically:

    Road Safety Minister Tom Kenyon said ....... "I understand it will be a bit of a shock for some of them. It's inconvenient, I understand, but this is a penalty for offences they committed. It's been delayed for two years," he said. "I'm sorry it took two years to get it sorted out but the offence was still committed and the penalty needs to be applied."

    i can see both sides, as minux said 'do the crime, do the time'

    but 2-3 years is along time and situations change, a guy could have been a single and un-employed hoon with not much to lose by losing his licence, in 2-3 years time, he could have matured and have a job and is supporting a kid and needs his licence, which is a harsh call.

    Remember this is SA where if you murder someone you get told off and have to stand in the corner for about 10 minutes. However write a bad cheque and you will never see daylight again.

    This computer glitch will affect 1000's of South Australians and at this point they are saying the disqualification sticks. I had wondered initially if under pressure they would be forced to back down and allow those who should have been disqualified to not have to serve out their cancellation, however this is SA as I said, surprised they didn't double the disqualification period!

    I say do the crime do the time.

    I got my p1 in June 09 and caught speeding in Oct 09, applied application for relief, paid the fine by installment. Exceed the speed limit by 10km , I was waiting for the letter of disqualification . But nothing came, until I am eligible to progress to P2, I called the service SA, they said you had no problem progress to p2, I got my p2 in Feb,2011.

    I will get my full license on 17/8/11.


    And now I got a letter today says I am disqualified because the offence in 2 years ago.

    like some people said, in 2 years time, I now have a partner and a job, what am I gonna do now?

    For those people who had their full license while committed the offence 2 years ago, they may just need to serve 3 or 6 months time or apply for good behavior, not a problem.

    For me, no matter what license I have now, I got disqualified of my P1 , therefore I would have to start again from L permit and wait another 2 or 3 years to get my Full license.

    U have 28 days til ur disqualified, not even 2weeks u can get ur opens. Go for ur opens, then see what happens after that. U will still have ur opens when u get off ur suspension

    U will have to read up on the details of the suspension, but get ur opens and I believe u may be ok. Hard to process something 2-3 years later and in ur case disqualified on p's.

    I hope from the speeding fine u have learnt something.. Never thought this would have come around so hard.. Chuck Norris is impressed

    On the letter, it says I must acknowledge receipt of this disqualification notice on or before 30/08/11.
    The disqualification date commence on 31/08/11.
    I can apply for full license on 17/08/11

    I will give it a try on full license, and see how it goes. I have learnt my lesson,I have no more driving offence after the one got me in Oct 09. Otherwise I would not have had my P2 already,and ready to progress to Full license in 8 days.

    I hope I can get away with it .I have my job, my partner,I can't lose my license.

    I know the crimes are so different that it is probably apples and oranges but I am fairly a sure a murderer could not use the "but sir my situation has changed" line. Sure murder is extreme to compare but both are crimes punishable by law and as such there is no real time frame on when a penalty can be handed down regardless of "computer error".
