    Default Pulled over for speeding, no fine issued on the spot?

    Gday

    I was driving pretty quick on my way home from work today probably doing 100 in a 70 zone, down a hill.. Drove past a cop on a motorbike, he spun around and pulled me up... He asked me the standard "Why do you think I pulled you over?" Rararar I just said I didn't realise how quick I was going..

    He went back to his bike, I jumped out and asked how he detected my speed if he didn't have a radar fitted or in use while he was riding past me in the opposite direction, he just said he was experienced and could just tell I was speeding etc.. He hated me getting up him about it and asked me to get back in my car... Had to show me how in control of the situation he was rararar

    He f**ked around for ages writing my details down in a little book and using his radio then came back to my ute and said I will get court papers in 6-7 weeks or something, I just gave him the old sarcastic "Good stuff, can't wait, I'll see you there mate etc"

    So has anyone else encountered this problem? Will this shit get thrown out of court or will I lose my license for 6 months?

    I reckon you might have dodged a bullet there. Did you admit to any speed or that you were speeding?? You might get a summons but probably unlikely IMO.

    Now that's out the way, not sure what its like in NSW, but in Victoria you need to be doing over 45 km/h or driving dangerously at speed in order to be issued with a summons.
    Doing 30 km/h over is a traffic offense, 4 demerit points or something but not a Court-worthy offense.

    I think you're lucky because he probably realised he couldn't ping you without genuine proof, or he wasn't a patrol cop (happened to me once, not-speed related), and just said that to scare you into conforming.......

    Man I hope I get out of this one, I didn't admit to any speed... He didn't definitely say I will hear from this, I can't clearly recall he may have even said "you might hear from this in 6-7 weeks"

    As far as I know if he didn't issue you with an infringement notice on the spot you should be right.

    And even if you do get a summons you can say you were doing 85 as opposed to 100, without proof he has no case.
    The more I think about it, the more I reckon you've dodged a bullet. Too many loopholes for it to go to Court

    Hmm, I don't know, I reckon you may have dodged a bullet. Provided you didn't admit to speeding, and he has no evidence of exact speed, all he can say is it looked like you were speeding. You're probably ok.

    But take it as a warning and good luck, next time you probably won't be as lucky.

    Just kidding, you're pretty lucky but you'll be fine I think, if the cop had no evidence of speed, like a camera reading or whatever, unless you were doing 100 in a 40 or 60 zone, you should be fine.

    He may face a careless driving charge. No specific speed needs to be proven in that case - just that he was driving carelessly. If asked to come in for a statement then the Police might be on a fishing expedition - say nothing and get legal advice. They are only after the statement so you will say something that admits guilt and helps their case.

    6 - 7 weeks? I think he just wanted to see you shit your pants for a bit because you got up him lol. Normally its within 2 weeks. You will soon find out.

    Sounds like you deserve the fine to be honest. I hope he does see you in court, might change your attitude a bit.

    You won't get anything in the mail but it is recorded in the police files. It won't show up on a record. But be careful. He will be looking for you on the same route home for a while.

    Just because they didnt get you on radar doesnt always mean your off scott free. Police opinions are considered 'expert opinions' on speed so if it did go to court and u said you werent speeding and the cop said you were doing 30+ over the limit then there is a chance they will rule in the cops favour and slap a charge like 'dangerous driving' like said above or whatever on you that doesnt need an exact speed proven. But in this exact case I think you dodged a bullet. Keep to 70 in 70 zones and you wont have to worry about it again.
    Also Id advise never to be smart to cops. Just say yes sir no sir thank you sir, regardless of how much you want to deck him, and then fight it in court if it comes to it. You only hurt yourself by being a smart dick to a cop when they pull you over.

    Man it would get thrown out of court for sure ive taken my fare share of cops to court desputing what they have said.
    The prosicuter would be nuts to try they will either as has been said try to get you to admit a speed or get you to plee to a certent speed ie were taking you to court for 100 but you can have it all delt with now if you admit to 80 they try that alot. At the end of the day deny deny or if you like you can try this if it goes to court. Tell the judge you done something stupid and gave the cop the finger while he was passing then you turn to the cop and appologise and then say i belive this to be the real reason we are here today the officer got offended and pulled me over then i was again further unpleasent to the office and again turn to him and appologise the cop will not know what the #### and the judge will think the cop got the shits with you so tried this speeding crap to get back at you with no evidence and a motive for why the cop pulled you over the judge would be off his meds to convict you of speeding sounds crazy i know but trust me ive seen something very simular work because in the judges mind the cop wouldnt pull you over for nothing you give him something and he cant convict with no evidence.
    O by the way probably not the best idea putting this on a public forum you have admited to what you done in your first post a tech savy cop will put 2 and 2 together even if it wasnt the one that pulled you up maybe another will look were your from and pass the details to the stations in your area good luck with it

    Sounds like he was just looking to make you sweat. Maybe he was off duty on his way home and CBF'ed doing the paperwork.

    Usually, when you get pulled over by a traffic cop, it's on the spot.

    Last time I had a situation similar to this, I never heard about it again, I was just sweating it for about 3 months. Punishment enough. lol.

    You'll be lucky if he doesn't throw in neg driving. It's negligent to not know how fast you're driving. The ONLY thing to do EVER is say "I wasn't speeding".

    Cops always ask you why you were doing whatever it is they have stopped you for so you admit it. If you said you weren’t speeding or didn’t realise then it helps you in court. I would have thought you would have received an on the spot fine so you may be ok. I am not one of the “don’t speed and you won get a fine” idiots and I obviously don’t know the conditions with regard to other traffic etc you were in at the time but seriously, 100k in a 70k zone sounds irresponsible.

    Speaking from experience and it may be different here in Vic, but if they do not fine you on the spot, generally nothing happens (just confirmed with a HWP guy I know down here). I got sick of sitting behind a tosser who would do 90 in a 100 zone where I couldn't pass and 110 in zones I could pass. Idiot me planted it and went around at about 135 lol. Bad move, the speed changer was an unmarked car lol. I always hesitate when passing VE wagons with tinted windows now
