Default debt collection? what can I do

    Hey all...

Back in Febuary, had a dvd headunit for my car, found a better one, bought it didnt install it.... mate saw it wanted it..... was going to sell it and he offers me $750 for it (worth more).

Tells me he'll pay tomorrow.... im like ok, known hte guy for 5 years umpired SANFL with him.

Next day comes he doesnt get paid, his employer did it to me constantly so yeah next week all good I know where you live...

Needs a wiring harness and me to install it, so I do a clip in installation..... $30 worth of clip cables (VY to ISO, ISO to JVC) clean install. Happy as hell with it, while im doing it he's eying off a spare amp I have.... offers me $100 for it... im like ok, and by the way if you want speakers have a look through that box of spare speakers see what you want.

a box of about $600 worth of speakers.... ends up taking them home to see what will fit.

Payday comes.... im getting a bit annoyed at him eating out yet he cant come up with the cash he owes me, gives me excuses after excuses..... i tell him look seriously hand the stuff back or fork over the cash.

Begs just 1 more week.... and im too nice.

I tell him that he needs to hurry the hell up the head unit is on my credit card.... it will attract interest if not paid off within 20 days.

20 days comes and goes...... I start to get angry at him and he keeps coming up with all these excuses, I go and see him at work he throws tantrums...... he starts to really #### his life up financially and then starts telling me when his TAX return comes in..... I get it, all of it to pay me off.

Im pissed but Hey its july he'll have it in a few weeks...

Months pass more excuses about the return not arriving but I havnt had mine come in (STILL havnt got mine thanks ATO). and I go back packing on the east coast I tell him to have the money ready for me before I leave.

Promises to make installment payments while im backpacking, I get to NSW...... and excuses...

By the time I get to qld..... he's deleted me on facebook..... and for his luck..... I get my phone stolen so I dont have his number, I email him asking for it and get no response. Get a new phone ask everyone else for his number and everyones all like 'I dont want to get involved'.

Get back to Adelaide and visit where he works dont tell anyone im back there so he doesnt do a runner, as soon as he finds out im coming looking for him he keeps ducking and hiding everytime i'm at tea tree plaza.

He's security tells his mates there that theres a crazy guy after him who is delusional and thinks he owes them money... this works until he finds out his boss also has a second job where I used to work and were mates. Gives him a massive yelling. Calls me up and tells me that if he doesnt pay me back he's going to fire him.

I find out today he's quit, and changed his address.

I've got no way to track this guy, I still have all the original reciepts, I dont have a contact number for him and I only know his last work place and last residence, I have copies of emails and dated facebook messages of him promising to pay.

And im guessing if I take this to the cops they will tell me take it to court, If I take it to court they will ask how to get a hold of him.

    Any ideas what to do?

Don't give your shit away next time without payment at time of delivery. Expensive lesson but sometimes that's what it takes.

Some mate he turned out to be.
Put it down to experience and forget about it. By the time you take it to court and pay costs and shit it won't be worth your while.

Take what you have to the Police... They will give you some forms to fill out. He has scammed you out of your money. You have the evidence there saying that he is going to pay and still hasn't. Once you return the forms, they will be sent to a specialized department who should be able to track him down without to much trouble, especially if you have his old address and he has only just changed it.

BAM! a decent solution right there, its pretty much theft, so it is a crime.
i don't think he would have COMPLETELY changed his life to avoid you.

Feel free to try but at the end of the day it's a civil matter and chances are the police won't be interested what so ever.

I think black stig's got it, Im just expecting local cops will want nothing to do with it.

I dont really know what their power is because we remember the story of the trailer up here earlier. It took breaking the law to get them to enforce it.

You have no idea how tempting it is to brick his window and take the headunit and amp and speakers out of his car..... but the law would stand by him there.

That and I havnt seen his car parked at plaza since I got back..... if i had I would have left a note on it or followed him to his new adress and said hi...

Seriously though I have gone debt collecting at 6:00 am knocking on their door and at other times with a chainsaw to repo my stuff. Both require knowledge of where the guy is and may or may not be strictly legal.

file it at stolen? you have all the receipts for everything, tell the cops you know the guy that took the item.

Dont know if this would work tho, just my 10 cents.

Put it down as a lesson learnt and bad experience. Wasting money tracking down a small sum like this will end up costing you more than you are owed. Personally I'd just move on and forget it, just isn't worth the stress.

Other option is to be like some of the posters in here and you could be a cool internet toughy and shoot him and shit cos yeah that cool bro /sarcasm

Take him to small claims, but you'll need a proof of sale or he'll just turn around and say "What stuff"....................... Thats going to be your only option, unless you do something stupid as suggested in the many posts above.

Like minux said put it down to a lesson learned, most lawyers etc wont scratch their nuts if the sum in question is under $2000, i feel for u mate there are some real good " mates" out there and sounds like u have one of them. Like the others said i wouldnt go as far as shooting him just " try" to forget about the tosspot, maybe if u see him around a smack in the chops as stress relief wouldnt go astray but honestly mate hes taken you for a ride, dont worry karma is a killer.

wondering what these comments where while I was at cfs lol.

Spoke to his sister before I went... and my god...

Started saying how she wasnt getting involved and hinted at me trying to rip him off..... questioned it and she's like you did a dodgey job installing it....

So i reply..... ok first thing im qualified to install them this is what I do as part of my trade atm, secondly.... I only installed the headunit not hte amp's or speakers...... and third...... are you implying they are damaged?.....

I then get her solidly abusing me and alluding to something dramaticly going wrong with all the parts....

Starting to think her 17yo bf who was going to install the speakers for him installed the amp as well and might have blown the crap out of some of the stuff.... and most common mistakes know it all kids make doing amp installs is not using an appropriate gauge fuse... or a fuse at all.

Now im thinking all the stuff might be damaged :@

So she starts hammering me even more about it...... and I then ask her.... ok so why isnt he the one talking to me...... no answer... starts to berrate me again..... and before she blocks me I just say to her

'so your telling me that its perfectly acceptable for your brother to steal items off me. rationalize that.'

This sucks..... I use to be really friendly with this family.... even tried to get me to date the sister (she was actually pretty hot hadnt seen this side of her, so glad i didnt .... and his mom..... this mate never used to be like this i could swear shes gotten her claws in him.)

Sucks on the whole...... and I know you guys think $1500 isnt much...... but most of this is gear I would have got nearly $3000 for online to non mates.

Due to having a car crash 8 weeks ago and breaking my ribs and it killing my ability to work for a long while...... I had to come back early from backpacking the east coast..... and yeah its had benefits like meeting me gf... everytime I look at this... just keep thinking of how even having just the headunit back and hocking that could have paid for an awesome xmas present for her, AND done a kickass summer season for youthgroup.

And instead this tosser is getting a freeride on my money.

If you have emails from them, it could be possible for me to track their IP, not saying I would cos' you know, I'd get my post removed, BUT if you were to forward the IP to someone on these forums, they could then track it back to where it was sent from, not saying anyone could, but you know..

Or just liek, shoot them wit da gunz nd chainsaw ther azzes up liek blat blat blood clot jah mon.

lol yeah i know what your getting at.... im working on it im just tryna be constructive at the same time i've had a real rough day..... on the way to cfs I had to take my girl (gf hates me saying that about my car) through the hills the long way just to tune out on some corners.

But yeah.... this is a guy who always wanted to be a tough guy, got a security license got a job as plaza security at westfield ttp and was always mouthing off about it.

And he's now apparantly left the job due to fear im coming after him.

Funny being afraid of someone who's still recovering from broken ribs and a punctured lung
