Call your insurance company, 3rd party will cover you if you can identify the driver at fault, mine is to the value of $3000 then the insurance company will get the money out of her. Your car gets fixed and your back on the road. Usually you wont even pay an excess, the insurance company will take care of the lot for you.

My daughter had 3rd party property with RACV several years ago and her car was damaged whilst parked but she got the other parties details, I can't recall whether the other party were insured or not, I have feeling they weren't, but even though my daughter only had 3rd party property insurance RACV fixed her car. If you have 3rd party property may pay to have a chat to your insurer and see where you stand.
3rd party property should have "Uninsured Motorist Extension" included in it.
If you have all her details and she is at fault and can advise them that she has no insurance at all, then you can lodge a claim under that UME and your car will be fixed. Then they will pursue her for the costs of repairs. Then its up to her to negotiate with your insurer to pay in installments etc if she cant pay outright.
Other than that you can send her a Letter of Demand outlinine the date and location of the accident and that you hold her reponsible for the damage, and that if she fails to pay in 14 days (the usual time that insurers sample letters of demand give) that you will commence legal action to recover the costs.

Sometimes people even say they dont have insurance when they do, because of not wanting to pay an excess or increased premiums. If they are in fact insured, they have to pass your letter onto their insurer to handle anyway unless they want the full bill themselves.
But you should be all good with your insurer. Ring them and lodge a claim and tell them you already have quotes ready to go. It wont blight your rating if you ever change to comprehensive either, as you're not at fault from what you tell us.
She's trying to take the mickey and string you along because youre young. Its not your problem if she has family issues and stresses. Its her responsibility to fix the damage she caused.

Call them anyway and just discuss it with them. Don't be scared of insurance companies, some of them are actually helpfull, the rest will just tell you to jump. No loss either way.
And yeah whinge to the cops as well, that will make her squirm.

I recently had to do this. All I did was ring them up, say I'd like to notify them that I had been reversed into and that I had the details of the "at fault driver."
They took the details, told me to take it to an "agree'd repairer" and now its booked in on Tuesday next week. No excesses/fee's etc...
So easy, and simple, I didn't have to speak to the person who backed into me, all I did was make one phone call.
FFS... don't you have parents that have been through this shite and can advise you, seriously????
Ok Advice:-
- GET ALL of her details about car/address/phone numbers/license.
- Type/Write up a letter stating the date/time/location of the accident and that SHE takes complete ownership/responsibility... get her to sign it, make a copy for her and one for the Police.
- REPORT THE ACCIDENT TO THE POLICE IMMEDIATELY, stating she has taken responsibility for the accident and present the letter she has signed.

YES.... The Police don't care as you have said and actually will not attend to an accident like this.... but I said "REPORT THE ACCIDENT" which means going to your local pig station and making a Stat Dec, legally binding in court, against her if this ever goes to court.
The report becomes a legal document and so she is screwed... especially if she refuses to give any of her personal details to vsowner94 which is illegal and the Police WILL HAVE TO investigate as this could be considered as leaving the seen of an accident without providing details.(A Criminal offense)

aside from all the shit about who is right and wrong and getting even with her,
have you tried explaining to her that the car is not driveable as its defective and would be put off the road, and that if action is not taken by her, you will regretably have to take legal action.
thats your first step, non threatening explanation of where things will go if you have to take action yourself, and your reasoning.
be sure to document every interaction with her, and every request for payment, if it does get taken further this will be to your benefit.
Similair thing happened to my brother and he went to court. Got the money - $20 a month for 3 years!. Had to pay for immediate repairs himself and was eventually reimbursed
sort it out asap, the longer you leave it, the less chance you have of compensation.
Have you got her details ? If yes - Get your 3 quotes and then send her a letter of demand. If you didn't get her details then treat as a lesson learnt.
If she doesn't respond, then you need to consider whether legal action is worth the cost of repairs or not.
I must be a c**t, if someone hit me and owned up to it I'm pretty much going to grab all details and submit a claim to my insurance company. They act as legal representation on accident matters and have the resources to find out whether someone does or does not have insurance.
Don't care what the person at fault says, it wasn't my fault and it's not going to affect my NCB if I claim - which these days is BS because people can protect it. Plus maybe they would get an adjusted increase in premium in the future - this person probably had so many accidents she cant afford insurance any more.
IMO - insurance should be like greeslip/rego - mandatory.
