Say a person cuts a corner, and either they hit my front or I hit their side, who would get the blame and what would insurance cover?
Hard to prove without witnesses but if by cutting a corner they have crossed over the line onto the wrong side of the road, I believe they would be at fault.
Well your statement included two variances.
1: They hit your front - cut the corner and you were stationary, impacting you. Their at fault.
2: You hit their side - you ran a red/went when it was unsafe to do so/didn't keep within your lane, you impacted their side. You're at fault.
Need more information on the scenario really. Even then as stated, without witnesses insurance decisions can be affected by the stars the moon and random other crud.

As a truck driver, I've copped plenty of people over the years whom have strayed into my lane and i've knocked a mirror etc...
If you're driving side by side on a dual carriage way and they are NOT in a merging lane that ends and they stray into your lane and you scratch their car or knock their mirror, no you are not at fault. As long as you did not leave your lane to do so.
If you are at a T intersection waiting for your turn to go and a vehicle cuts the corner and clips the front of your car, I would believe that they are at fault as long as you were behind the line on the road indicating where you are to stop.
I have driven over the top of a Toyota starlet with my truck at the 5 ways at wyoming years ago because they did not obey the direction arrows for her lane.
I was in the left lane and could legally turn left, veer ahead left or veer ahead right (left into macca's, ahead left into henry parry drv or ahead right into pac hwy) she was in the right lane and could only legally drive ahead right into pac hwy, turn rifht towards the shop complex or do a u-turn from her lane.... unfortunately she drove ahead left while i legally turned ahead right.... result, she has a pancake engine bay and very lucky to be alive and cops gave her a couple of fines to boot.
Me, a tad shaken but was told by cops I was free to go.

or the other option they cut same corner and sidescrap your car by cutting said corner.
which would be pretty hard to prove anyway.
this has nearly happened to me many a time as i live near a very blind corner that probably 50% of people dont know how it gradually increases/decreases in turn radius (no joke on that part, it actually gets tighter in some parts), thus they manage to cut the corner and certain (very blind) spots
If it was a theoretical question, then
1: Their fault. You are stationary and they hit you.
2: Your fault. You are moving and hit them. Doesn't matter that they are doing the wrong thing at the time by cutting the corner, you can stop and avoid contact. If you keep going simply because they cut the corner, then you still hit them and you are at fault.

Like literally a few times around a blind corner, I have had a guy in my lane for probably 5 metres, we were both looking down to my right to look for cars, then he looked back and I had braked, but he swerved and missed, luckily. (That was like my third day on my P's too.)
I can't possibly be the one blamed if he had hit me?
my gf was entering a carpark turning right a woman was leaving turning right she hit my gf's car,
she failed to give way to all oncoming traffic.
her insurance company laid blame 90% her and 10% my girlfriend. we accepted their finding otherwise we would have had to make a claim on our insurance and pay our excess and wait another week or two.
the point being insurance companies look at each case and lay blame on a percentage basis, if it is not entirely clear to them who is at fault.

Well I can understand if I'm parked or somewhere illegal. But not really in this case.
I live at a double intersection and 95% of cars cut the corner (they look annoyed and inconvenienced when theres a car waiting to turn). It will be hard to prove that they hit the front of your car by scraping the side of their car by cutting the corner on the wrong side of the road. I've had one moron hit me in the quarter panel about 10 years back when I was stationary and he tried to pin it on me and make me pay for his car but I had an independent witness that it was his fault, he was speeding and fishtailing moments before. AAMI kicked and screamed and kept sending me letters of demand until my neighbor at the time came forward and made a statement. Witness > everything lol
Is having somebody in my car a valid witness? Or do they need to be out of both cars and/or not associated with me?
