Last night, stopped at the a red light and a guy was crossing the road on a scooter. He managed to somehow fall off, and having a full car (ages ranging from 22-42) at various stages of intoxication, all laughed quite loudly out the window, as you would right?
Now this is where the do-gooders come in and say 'you provoked him by laughing, you're at fault'. Please don't comment I don't want to hear that, laughing is not a crime nor should it provoke somebody to react in the way that bloke did.
He preceded to pick up his scooter and over arm throw it at my car. I have had damages quoted at roughly $1500.
After he hits the car, I pulled over in a service road and the passenger in the car sprinted across the road to make sure he didn't get away. My passenger pushed the bloke who proceded to lie on the ground saying "man i'm so f--ked". He was clearly pissed out of his mind probably on drugs as well, looked like a genuine dropkick. Just imagine a mid 20's bloke in a construction company top (probly nicked it off a mate if anything) riding a scooter at 8pm on a Saturday night. go figure
Police were called and details taken, la la la. They quite clearly didn't believe his b--lshit story about him 'falling off and us trying to run him over'. The coppers said to me that they will call me in the next week, hopefully having him charged. He will be forking out the money for repairs, only problem is that he didn't look like he had 2 cents to rub together...
What i'm trying to get at is, if he doesn't have the money to pay, am I just stuck with the repair cost?
do you have comprehensive insurance, if so they will chase him for the costs, if not, and he CANT afford to fix the car he will have to pay it back a few bucks per week until its fixed, which basically means you have to pay for it until he can cover the cost.
LOL I have been accused of being a do-gooder but in a civil case I reckon he would be ordered to pay for most, if not all of the cost. Him being drunk/stoned does not help his case. If you get no satisfaction out of the cops, see a solicitor and try to sue him; he may well have $1500 worth of assets that could be re-poed.

Yeah I did think about insurance, but the cops said don't even bother. I might go to a solicitor and see if they can help me.

Why provoke someone who fell off a scooter? Did it occur to you if your equally off their head mates had not laughed but offered to help him up, your car would not be damaged.

I'm with TVR on this one. Let your insurance company chase him for the money. You get your car fixed and you don't have to deal with the tard.

Laughing can provoke someone, and im afraid thats what you blokes did. It can be just as intimidating and insulting as worded insults.

Agree with the persons above stating to not bother with what the law and pay ya excess and get ya car sorted out quick smart.
If you want to, you could pursue the matter legally but that alone can be a long and costly battle.
Regardless what the cops stated to you, the person can still claim you did in fact provoke and also if he sobers up can say that you did use your car as a weapon and moved ya car forward with a revved engine towards him and so he became scared and ran off and was chased by you lot. His initial statement would be meaningless as he was under the influence.
He can very well make out as though he is the victim.

Do you have comprehensive insurance if so call them up make a claim, explain to them that the police have the at fault parties details and pass on any details you have on this guy. Then just let the insurance deal with chasing after this ######## for damages. Your mates were stupid but this guy acted illegally and quite frankly he is lucky he didn't have everyone jump out of the car and belt the living shit out of him.

if you have insurance and because you can identify him you shouldn't have to pay any excess
this is what happened to my daughter a couple of years ago when some abos kicked her back guard in and also smashed the rear window
because she was able to identify them the car was repaired and it didn;t cost her a cent
scooter fags deserved to be laughed at end of story,should have run him over.
If anybody falls off anything, its your given right to laugh at them as hard as you see fit.
It is also your right to run your vehicle over him several times.

I think I'm just gonna bear the costs of repair. I have dropped the case with police, could not be bothered chasing him up for the money that even the police didn't think he had.
couple of hundred bucks here and there will sort most of it out. With a wash and polish i'm hoping the scratches will buff out and the dints become that little less noticible.

I do, but don't. I'm not a listed driver and the excess is $2000. It'd be cheaper and easier to sort it out myself.
