    Default wrongly accused

    last night i was out partying in another town and apparantly there is a video of me in my car doing a burnout about 80 km's away form where i was...... now this morning the cops knocked on my door and made me get my car out of the driveway and onto the road so they could do a vehicle inspection??? i asked them why and they said they ahve reason to check my car over for any defects and i ended up getting defect for my rear brakes not working properly.....which is a load of crap how they tested it....put it on the gravel held the brake on and floored it to see if the wheels would spin OF course they are going to bloody spin!!!!
    now i am taking them to court about it and asking to see this video and the person who accused me of laying straps on the road and they wont give me an answer!
    can anyone give me advice on what to do because i am confused as all sh!t about the whole event

    sux bro, just get witnesses to say where u were and say that they used improper practices in testing your brakes (redo the test for the court)

    You were MADE to get your car out onto the road so they could defect you ?

    Sounds a bit much to me... don't the cops have to have some sort of warrant to search / inspect your property when it's on private land ? You shouldn't have moved your car mate ! I wouldn't have if I was innocent... And was being accused of something I didn't do... I would have told them where to go... show me the evidence... or prepare to be sued for Police Harrassment.

    It sounds like they only had one intention on their minds.... or maybe your no angel and have developed a little black book of bad driving behaviour from the locals ?

    Who informed you of the video?
    Can't charge you on that count until it is provided to you.
    You have witnesses of where you were, as per the previous post.
    Unless the video shows the date and clearly identifies that it was on a public road they would be hard pushed to charge you.
    Have you ever had a burnout filmed by somebody who is no longer a friend?

    The brake inspection is a joke and if they defected the car stating this as the reason they would get laughed at in court. What exactly does the defect state?

    i ahve the only copy of any burnouts done by my car..... that cop is hell bent on pinging me for it..... ive made a complaint to the head office of police in adelaide abou it..... filed a police harrasment complaint about it but i dont think they are going to take much notice...
    im not one to be ignorant to coppers so i moved my car thinking it was only a general checkover for rubber spray and stuff not a full mechanical inspection of the car...
    i know who might have done it but i cant prove anything so im waitin till they slip up and do something worth videotaping to give the police a real criminal to catch..

    Add the ombudsman to your list of people to complain to.. ASAP.. They ensure things get done..

    Coppers don't always like to hunt their own.. Ombudsman makes them..

    im going into the station tommorow to make a formal complaint about it so ill get the full story then i spose but im not happy about it all...

    seems a little far fetched for anyone i know to make up they arent smart enough to set this up without a good reason.....
    i know who was doing the burnouts but it definately wasnt me and their car is the complete opposite colour to mine...

    wait wait wait.....they actually came to your house and got you to be a gravel hero by dooing a standstill(not in thoese words)? hahahaha thats funny cos thats what there sayin you did in the first place!

    Go to court my friend...you got whitnesses..you got a win...and that doesn't sound like a good way to test brakes...kinda means mine is defective too....hmmmm sue em' for that too....

    Don't make a report at the cop shop alone.. By all mean do it, but also write a letter the Ethical Standards Department (or whatever the SA equivalent is, just ask) and CC a copy of the letter to the ombudsman..

    Only way you'll get results..

    They legally couldn't force you to move the vehicle off your property and into the street w/o a piece of paper saying they can, you screwed up by saying yes because once you got it off private property and onto public property they used their unethical tactics to get you.. It's not fair, and I hope you can get off it!

    It all sounds a little 'out there' hey...

    Police don't need to show you anything before charging you. They don;t have to prove anything to you, just the court, especially with a traffic offence. They would just have to make the footage available for you to view at a time of their convenience.

    They things they need to bve able to prove are;

    1. DRIVER, (YOU)
    2. VEHICLE (WHATEVER CAR IT IS ALLEGED YOU WERE DRIVING)
    3. TIME, DATE, PLACE (ROAD RELATED AREA)
    4. BURNOUT (BROOM BROOM, WHITE STUFF)

    There would have to be a written statement to accompany any footage if not obtained first hand by the police, ie the cops recorded it themselves...

    You should allege that they tore up your tyres on the gravel an maybe casued a puncture amd senmd them a bill with a letter of demand... That would be sweet. I don't like it when other cops do things like that, its just ridiculous.

    Good Luck, I think everyone has given you the right advice so far. I'd just happily take it to court, and let it all unfold, If they haven't got you then they haven't got you!

    that makes me think, if a cop turns up say's you have been reported for doing something, and they ask ya to take the car out onto the street for a snap road worthy, and the car is found to be un-roadworthy, can they get ya for being on the road with a unroadworthy car? even though they make ya drive it out there?

    and as no one has already said, burn the 'only' copy of the burnout video you have so its well buried and gone.... just in case.

    garth, i have heard of it beng done with show cars on trailers, they get you to drive it off the trailer to check it and bang, ur on the road with an unroadworthy car and they ping you.

    ok ive been flat out gettin my car ready for road traffic next week so i havent posted up in a while....
    ive confronted the copper and got him to do the same test he did on my car in his SS patrol car since it is his way of testing vehicles brakes.
    omg well what do you know it spins the wheels AFTER he took the handbrake and traction control off
    now ive also been searching around about the brake load distribution that all utes have..... ive found out that the front brakes do 80% of the shared work load according to the road traffic book!

    i also told him i want a court date if he wouldnt show me these burnouts i was apparantly doing..... i also got to see these burnout video's form saturday night

    heres what i saw
    1. a hothouse green VU ute doing burnouts
    2.definately not me driving the friggin ute as i dont have blonde hair.....
    3. the ute was a V6
    4.it had 4 stock 16 inch mags on it
    5. the footage is 1 and a half months old according to the camera

    so all i am left with now is a defect for my brakes and suspension

    Stealth, in on-road behaviour and general driving is good my friend.
    Purchase a hazard-warning triangle for your car to improve the warning given to approaching traffic at both crash scenes and vehicle breakdowns. Keep it in the boot.     yeh it would be pretty funny to see what the copper would of said about it
    i dont think i need luck with the inspection cos it is going to be the fourth time round.... i dont think i can actually replace any more parts on my car

    So the video definately isn't of your car? But you have done them before and video taped it?

    Sounds like a pretty crap way to test brakes aswell.. thats like pouring oil on the road revving the car to 5 thousand and dumping the clutch. Oh it spins, your tyres don't have enough tread.

    Bad move by moving the car though, as has already been said, I would of just said no. Too easy.

    i have the only burnout video of my car, it is locked on my computer so only i can access it.
    its definately not my car nor none of my mates driving, the date that it was shot i was at trade school,
    now im not one to be ignorant to police because thats the last thing you want to do when your on your P's in a country town..... if i knew what they were looking for before i got my car out on the road i would of left it in the driveway where it was safe....
