    Default why does the MAN screw us???

    As a few of you know i was laid off work with a crook back and sleep apnea. ive been off of work for three weeks and was promised my job back when i get cleared from work. i phoned up today after my docs cert was faxed thru and was told my position has been filled. why couldnt they tell me that 3 weeks ago or even a week ago, i could of been looking for work. now my family is fuct. we had all our bills postponed untill next week which is when i WOULD have been paid. why does tha man do this??? look it wont take me f*ck all to find a new job but its the wait for pay thats goona screw us.

    thanx john howard for you new labour laws THAT STOPS ME FROM GOING FOR UNFAIR DISSMISSAL!!!!...

    anyone with a legal mind on labour relations got any ideas if i can at least claim the compo that should of been offerd to me??

    work status...

    1500+ employees
    Casual fulltime 60 hours a week
    12 mnths employed
    fell asleep at the wheel cause of my sleep apnea. no accident at all involving machinery.sent me to work shop in town.
    did my back in and was told to go to chiropractor and see what he said, he told them no manual work for 4 days.wasnt offered injury statement to sign they told me get sleep apnea treatment and you can have your truck back.
    3 weeks later told i cant have my job

    As best I know as the business has over 100 employees unfair dismissal is still in effect.

    Mate thats terrible. I feel for you. I know exactly where I would be without my job, up sh!t creek without a paddle.

    Your correct in that assumption.

    As far as putting in compo claim now, I think you have to do it at the time. To look at it now, currently your not employed by them, therefore you cannot submit a claim for compo.

    First I would find the reason for dismisal. If your employed on a casual basis your probably not going to have much recourse under unfair dismisal laws, as I believe a casual employee can be terminated at anytime.

    I take it your a truckie. Consider this scenario. If you claim workers comp, your going to find it harder to get a job if you have to declare a claim on employment forms, either for a bad back or worse sleep apnea, as employers will be hesistant to let you drive their trucks if there is a chance you will nod off again.

    Hope things turn around soon for you. Life can be a bitch at times.

    thanx guys. yea i know i dont really have a chance in hell at getting anything. never mind lifes all about these challenges. just one more fence for me to climb over. just felt like having a whinge lol . im over it now time to start hunting for a new job

    as a Casual you can be replaced at anytime and had your job taken by someone else etc. In regards to the back injury you should have told the doctor it was a work related injury and filled out a Workcover Form. this way you could have claimed for workers compensation, but the end result would be a small pay out and loss of job anyway cause they would say they have no more hours for you.

    Make sure your next job puts you as full time or at least part time.

    I'm not a lawyer but u may have a chance of compo.
    It depends on when the accident happened, what I mean by that is, if the accident happened prior to the new I.R laws coming into effect then possibly your employer is still legally bound by the regulations in place at that time.
    Check it out with a employment lawyer even if u just ask the question, if u have ongoing problems with injuries the employer may still be obligated by law to cover medical expenses.
    It can't hurt to ask a question.

    Actually even under new I.R laws, if you are off due to a medical cert even as a casual your position cannot be filled. Also, a compensation claim CAN be made as the injury was seen too at time of occurence.

    yea the injurys happened at work, the health lady told me to go see a doc. got a docs cert blah blah blah and told them no manual work. (which was crap cause my back aint that bad) BUT work didnt make me fill out a work injury cert. nevermind but. just been in contact with another mining mob and it looks like i may be going to them. better money n better machines

    start tuesday. 21 buck an hour 10 hr a day 5 a week. love it!!! beats the 19i was on 3 weeks ago YEEEEEHAAAAAAA go timmy go. now i just gotta find some dollars to hit the piss this weekend and go cruzin hahahahahah
