As the title states, have any ppl here been done for it?
As you may have guessed, I'm up the 'you know what' creek without a paddle, and some advice on how to best deal with it would be much appreciated. I've seen the minimum penalty and I'm not too encouraged with what my lie ahead for me. Plus, I'm aware of this current 'Anti-Hoon' trend and I really seem in the deep end. Also, any coppers here that can shed some light on the matter.
First things first, I did two bog laps around a `round about and I'm currently organising to see a legal solicitor. What from here, what is the best course of action. For interest sakes, I'm not wishing to challenge the charge, and I will plead guilty, I just dunno whether to go to the hearing or not...
I think you are already doing the best thing by getting professional advice. Be guided by your solicitor - I suggest facing the magistrate would be a good thing. I doubt they take a kindly to sentencing an empty chair. Get some references from people whose views might be respected in the community and also know you. You will be in for whatever the magistrate decides but at least showing remorse and how "out of character" your actions were will minimise any penalty.

basicially what reaper said, there's not alot you can do and on the day if the judge is in a crappy mood watch out.
Idiot. Ok that being said on with the formalities.
by pleading guilty you are already showing maturity to the magistrate. If i was you i would go to the hearing, it is best to get it all over with ASAP, plead your importance of a car for work etc etc. You really can't do anything, a lot depends on A. how the police will present, and B. How the magistrate feels on the day.
Present yourself as if you were going for a job interview, stand up straight, look like you deserve to be let off with perhaps a fine or Community Service.
I wish you luck, as i have had 2 people i know charged with the same offence here in vic, one lost his licence for 3 months, one was fined $2000. The latter was well presented and admitted guilt, the first tried to deny and looked like shit.

I think your a moron and deserved to get caught. Now your having a big panic attack and sooky cry whilst trying to lessen the punishment. I hope they throw the book at you because anyone driving like a hoon on the road, deserves everything they get.
If you haven't learnt from this that you can't drive like a hero on the road, do us all a favour, sell your car and use public transport until you grow up.
C.
Front court, dress well, look and listen to the magistrate.Let him see that you are really sorry. They really dont give a sh#t about you needing your car.Just cop it.Been there done that, just try and learn from it.Good luck.
Well I can't say I disagree, considering to that time I had, albiet, a proundly unblemished record, I'm disgusted in myself. That aside, this entire process, let alone the punishment I'm to face, is by far enough of a deterrent to be so bloody thoughtless and inconsiderate, your right, driving like a hero is not the right thing.
I wouldn't all this a sooky cry though, yeah I'm a P-plater, yes, I made a very silly, illthought and foolish choice, one bad mistake, and I got caught red handed. Yes, I should cop the repercussions on the chin, but there is nothing wrong in seeking advice in a manner to do this in the best manner possible, and for all parties involved I may add.
i got charged for reckless driving when i was 18, it was because i was at fault in a "serious accident". i dont remember much of the details, but i think i had the charges reduced somewhat because i proved that i had lost control because of a poor road surface, and the police from the scene backed me up on that.
i had turned into a street that had a sharp down hill corner right as you get onto it and it had recently had alot of roadworks done to it. there were no signs warning you of the road works or of the loose gravel, of which there was quite alot.
so as you can imagine when i hit this corner at about 40k's the back-end swung out almost parallel because there was no grip on all the loose gravel, i over-corrected and swung back around into on-coming traffic and took out a ute coming in the opposite direction.
no one was hurt (luckily) but both cars were badly damaged, my vp especially...the whole passenger side was crushed in about 30-40cm and the roof was all bent up out of shape.
anyway, when i had to give a police report to the cops who showed up i told them to go look at the corner and they took note of all the excess gravel right across the road. they said they still had to charge me with reckless driving, even though poor road condition had contributed to the accident.
i think i ended up with a $400 fine or something, and maybe some demerit points taken off me.
Ease up turbs, lil harsh ay... We all make mistakes, Im guilty of it and im sure alot of other people on this site are too. Luckily I got off with an excessive noise fine and a "hoon warning". Dress nice and be polite, get some reference letters and legal representation. All that does help, I got done driving whilst disqualified, faced the judge dressed nice, was polite, showed him I was studying at Tafe fulltime, showed reference letters and I got off with a $400 fine for a jailable offence. I was shocked! Good luck buddy!
Yeah - sounds good to me - hang on - why don't we just march him out the back, crush his car and hang him now. At'll learn the evil twit!
Give the guy a break - he knows he's screwed up. I don't know exactly what he did but it looks like he is going to face the judge and cop whatever he is given.
There is nothing wrong with trying to make the best of a bad situation. As long as he isn't lying etc it is exactly what every member here would do in the same situation.
Reaper
I got no doubt that he's learned his lesson and he's sorry.
The problem is there are some that don't learn and the punishments, only my opinion, need to be tough to make sure people get the message.
Nobodys perfect and we all make mistakes but reckless driving not only affects you, it affects other road users doing the right thing.
Having a licence is a privilege, not a right. You might do well to remember that.
That is exactly how I see it now, foresight is a blessing a-lot of us don't have, however, even though I am guilty of being a ******** road user myself (well, as of now), I can't see why or how serial offenders of hoon laws should get it easy. However, most of as make a bad decision and screw up, I am sorry, yes I've done the wrong thing, but I don't see the sense in using a sledgehammer to crush a chestnut... I might as well be cruxified for spitting on the side walk...
Is it your unhappiness with your weight problem that lends you to being an asshole, the guy just wanted help, keep your bullshit to yourself I reckon.
Oh and the advise regarding dressing well, and maybe getting some people 'of standing in the community' to come to court to give character references is correct. Unfortunately getting a judge having a bad day is really only something you can fix with an adjournment!
Well what kind of references are on the board here? I graduated from High School (Aquinas College, in Perth) last year, and I got a pretty decent school reference there. Is one enough? is more better? do school references hold enough weight?
Ok people, I'm sry for driving like a tool on the road, I made a mistake and I'm sorry, it is a by-product of humanist imperfection, I apologise for failing to be infallible!
I had a moment of a dire lack of common sense and good judgement and I will pay the penalty, I even think I deserve a penalty because I HAVE DONE WRONG. However, I have every right to have myself represented in the correct form, to go about this process in the most cooperative and just manner possible, and I do have the right, to harmlessly ask for advice!
To those that understand, and have been there before, and those that have decided to give me sound advice, both from personal and 3rd person experiance, you have my gratitude.
On a final note, I realise reckless driving is a jailable offence, for a maximum of 6 months for first offence (I think), with a maximum fine of $1000 and a possible 18 month suspension/cancellation of licence.
Does anyone here know if more than a sub 1k fine and six month suspension has been issued to friends/family or work collegues before? A workman of ours lost his for 18 months and a 2k fine for 'reckless driving', because he was weaving between trucks and cars, crossing the wrong side of the road, and evading police, being also charged with 'failing to stop when called upon'.
Now what our workman did is what I would define as reckless driving, but in comparison to that, and to doing a pair of burnouts on a roundabout, is a 6 month suspension and 750-1000 dollar fine reasonable, should I expect soming more, or worse, or am I about on the ball?
Cheers guys (and gals):
Marco
It does matter how you present yourself, wear trackies and talk like a moron and the Magistrate will notice. Its true about doing thier gardening coz i have spent many a day in court and i look after a head magistrate and chief justice of the Supreme courts garden and it didnt do shit.![]()
Forget about going to prison,it will NOT happen.Id say 6 months cancel(you need to sit for your licance again if you are a P plater)(thats what i had to do)and prob a 5-600 fine. The time will pass quick enough.
