    Unhappy got ripped off $$$ today

    Today me and the old man (both carpenters well im apprentice) got ripped off 4 days pay the prob was when we started this job the builder was asked if when the time came he would get propper scaffolding in so we could do our work and the reply from the builder was yeah no worries fellas so we went ahead only to get dodgey scafold and the old man nearly fell off the roof! if anyone has done blueboard work they would know theses sheets arent exactly light they are 3metres long by 120 wide but this builder wanted us to walk out on the 25 degree roof with theses sheets and nail em up! so we did what we could with the result of nearly falling off the roof & just to clarify the roof that im talking about is the garage and back/side of the house about 5mtrs off the gound this is a 2 storey house! then to make matters worse the old mans mum my grandma gets put into a nurseing home from demtia and so the old man says stuff this we will finish up today and get a new job!( being depressed and worried for our safety) but when it came time to pay up this bloke says nope your apprentice was to slow it was painfull to watch him work wth?? so the old man trys to reason with this guy even going as ar as saying: take a $300 deduction from the amount quoted wich was only $1200 (as we had had to cut a few hours short to see grandma) and this guy wont budge! well all i can say is its no wonder the building industry is i need of tradies because from what ive gathered this is a regular thing in the building industry! well sorry fellas for the long gripe just my bit for the day!

    yeah try to take him through small claims and therein lies the rub because to do this is such a stuff around that most people say stuff it and go on to the next job inline

    I don't see why the guy shouldn't have paid. If it took a little long, so what, its a fixed quote. If it took 2 weeks for a 4 day job and you still charge the same he should bloody well pay.

    I was an apprentice cabinetmaker (quit after 8 weeks because of the abuse I got and safety concerns) and I copped very similar treatment which was the last thing they did to me before I told them to stick their apprenticeship.

    A team of about 5 guys plus myself was out doing a shop fitting job for a night club and for days the other blokes sat around on their asses while I was constantly told I wasn't working hard enough and that I was lazy, despite spending the whole day either wheeling a barrow full of cement up two flights of stairs (yes... stairs!) or on the end of a jackhammer lifting vinyl flooring. I once spent 9 hours on the end of the jackhammer with only a half hour lunch.

    When back at the factory the boss pulled me aside and said that the other guys had told him I wasn't pulling my weight... that was the last straw so I quit.

    I sympathise greatly!!!

    Definately take him to small claims. Put in a claim and then go back and tell him that he can either pay or you will continue with the process. I'm sure he has made his money by ripping people like yourself off.

    mate i know where your coming from! the government realy needs to do more to ensure some kind of fair go treatment for apprentices and tradies because this is happening to much! and the government wonders why the building indutry is stuffed!

    cheers fellas for the ideas i might take him through small claims i spose at least if i dont get anywhere next time he might think twice before ripping someone off after the hassle it will cause him!

    You're right! I would be a qualified cabinetmaker today if I had a responsible employer back then. It put me right off ever becoming a tradie.

    hey cx if you take him to small claims he will have to attend the case if he doesn't it's more likely you will be found the winner of the case cause it will piss the judge off to no end when someone doesn't turn up. You're right for a few hours on your part he won't want to do this again.

    well the old man said wait till tommorow before i stirr the pot as its officialy pay day tommorow ( i dont see the point!) as maybe he might pay us (ha ha ha) but he and i know that thats wishfull thinking so im just waiting till tommorow then i will start the process of small claims!

    Take photos of the scaffolding if it is still there, that will help your case too.

    If you do the work and don't get paid then thats illegal! A month ago my brother in-law quit his job of 2 months as a pool cleaner. The aggreement was when he was hired that he'd work for 12 months then buy the work van outright and take over the business. Just two weeks after starting the boss starts abusing him demanding that he pay $4000 for the Econovan (which was not in the best condition). Anyway the boss became abusive and rude quickly so he told the boss to stick the job after he got paid his wages of $1000. The next day after depositing the cheque the boss cancels it. Even his solicitor told him it was illegal to do that. Unfortunately in these situations most people don't know where to turn or what to do.

    It's not just in the trade industry either. I'm a high school teacher and was with the independent (not private) system. I went back into the NSW education department beginning this year and so far I've lost all of my 5 years of long service leave that I had saved up and I'm still waiting to get paid. The school faxed AND posted my bank and tax details to the dept and they lost both! Plus they've put me on the wrong classification even after sending a statement of service with my correct classification from the previous employer which means I'm getting paid less than I'm supposed too. The NSW dept of Education is hopeless and I'll be thinking twice about sending my kids to a dept school after seeing the difference between gov't and independent.

    that sucks dude im in the same sito as u, me + dad team me being the 3rd yr app . . . we had a few blokes like this mate, they need a good kick up the ass!

    for $1200 i personal wouldnt bother takin it to small claims . . (but hey good on ya, hope ya win!)

    yeah im a first year apprentice in brizzy south east do work all over brisbane! but ive been working with dad as an offsider since 2002 (lots of reno work and built a home out at karalee ipswich) we had a falling out and didnt speak to each other for a long time... but after time both me and dad got over it and he offered me a job so i said to him, dad the only way we are working together is if im an apprentice and clearing at least $600 per week (i have my own family to look after 2 kids) so about a month ago called sarrina russo they did all the paper work & made sure the apprentice ship was legit & we started working together and been sweet ever since! but @ the end of the day i spose the bright side is we have just picked up a job thats bringing me home a grand a week and that will give me the needed funds to pick back up again!

    sorry to hear about your situation scooter looks like this idea of ripping people off is far to common and it aint going to get better with the new ir laws i mean if you walk into a shop and go: hey mate (bloke behind the counter looks up @ you) im gonna take this $600 dollar watch cya !and then walk out exspect the boys in blue to be paying you a visit! but this is exactly the same as whats happening when people rip you off in the building industry or any industry for that matter &wheres the help for us ?? i mean stealings stealing isnt it?? i mean whats the diference between wages and a watch? nothing! but its a case of oh well ho hum just have to take them to court wth?? anyways hope you get your money outta them good luck & all the best mate!

    screwed. i know what those blueboard sheets are like, ive had to do some myself.

    if he still refuses to pay threaten him with legal action. or, if he pays up some of it and not all just wait till the cheque clears and then go rip half of it off. i know it is more effort but still, if he is paying for half a job then he should get half a job. on the plus sire, when you rip it off make sure its FUBARed and the material has to be thrown out. not only will he have to pay for material again but also for someone else to redo the work.

    is he a big builder, or just a private or owner builder?

    i think hes a private builder not sure on his backgound but yeah we will see what happens after tommorow! the old man said to stick it out for the night and see if he comes through tommorow and if not i will be takeing legal action! but the worst thing about this is he will no doubt hire some unsuspecting carpenters and rip those poor bugers for all they have to

    well some good news today! my old man spoke to his old man whos a builder and he told him how to go about getting our wages and the old man went and seen our old boss this morning ang he paid up still he took out $300 but somethings better than nothing!
