Default Ute got written off yesterday,insurance question.

Hi all got heavilly rearended last night and my Rodeo is no more and my neck too.My question is because the claim will be giong through her insurance RACV can i get the car back?Does anybody know what the process is?
Oh and i need another tray back ute if anybody knows of one going cheap.
Any help from ANYBODY would be appreciated.

Yes you can get the car back. They just deduct the salvage value from the payout.

yeah had this happen to me last november. Because your not at fault and their insurance has to pay for it the insurance company has no legal right to take it off you. They will minus a salvage value from your cheque. Check what the salvage value is because it may be more than what its worth.

yeah, what maginoodle said. your not at fault, neither is it your insurance company - they have no claim to your car. this happened to me a couple of years ago in my VN calais, i got rear-ended at about 40k's/hr and at first the bloke at faults insurance company were going to write it off and told me id keep the car and get paid its valve (double bonus! lol)....instead they changed their mind and spend $5k repairing it! idiots, my car definately wasnt worth $5k...i bought it for $4500 almost two years before this accident.

Thanks for the info everybody,in glad i will get it back so i can wreck it out and recoup some $$.I have some damaged tools resulting from the stack and they will have to pay for that too id say.

good luck with it mate, and good luck with your neck too. i had the same thing happen to me last october. i've been in physio twice a week ever since then, and my neck is so fvcked its not funny.

the only good thing is that it was work-cover, so i don't have to pay for it.

dunno about the tools... my insurance will only cover $400 in personal belongings in the car. tools, cd's, anything which didn't come with the car. even kiddy seats are only covered up to a certain value

Im hoping it will be different for me as its registered to the business and not private.
