    Take him to court.

    Sue him.
Have a court Judgement made against them.

Will stop him getting any sort of credit for the next 5 years once it is paid in full.

I did this to my cousin, after he took with 8k i loaned him. He was planning on using my money to buy a house...he didnt realise he had a court judgement against him. Pity the fool who signs a contract and runs.

It's a difficult one! What route you take depends on how much you value the friendship over the money, or the other way round, and also whether you still have proof of the transfer to your friend. I'd be looking at getting some sort of court action going I think.

Court, this is a clear cut case and youll get your money back.

You can prove the transaction via bank statemtns linked from yours to his and the court will rule in favour of you.

Its a verbal contract and as long as there were expressed terms such as time to pay back etc. youll be sweet.

basically all i have is msn chat logs, and sms messages about it. another twist. i lent it to them in installments. i sent them 1800 at one time, and they told me they never got it. i have the feeling theyre lying so they dont have to pay that back, even though i talked to someone at their bank and they ensured me that it went through.

Your bank statements should show the transfers though?

Vcat won't do ****. We seen first hand how pathetic their system is. A family friend lost HIS business and HIS property because of vcat.

A Court Judgement is the best way, although you may not see the money back. Unfortunately no matter what you do you may not see the money back.

If they are claiming they did not receive the money, try contacting the bank and tell them it was deposited to the incorrect account?

Has worked fine for me several times. When I'm chasing money Vcat is usually the first legal step - it's very cheap and puts the defaulter on the back foot if the matter gets to the magistrates court (only got that far once).

From my experience the best thing (in any court) is to be organized, have all of your documents at hand and make things as simple and clear as possible for the judge (?) to understand.

Would threats of court scare her enough? It'll get nasty. If someone is willing to take you for granted like that they are likely to be a PITA when you want it back.

If all else fails ask her for a receipt and tax dodge it as a donation. lol. (though i think there might be a limit on that....)

yeah get bank statements together, see if they bank will re print your statements from the last few months (or whenever it was you lent it to them) and make sure you have sufficient evidence that you lent them the money and take them to court.

Do it by the book it's the best and safest way, and, if you have enough evidence then there is no reason why you shouldn't get it back.

Sucks to hear mate, but i would have been the same with a good friend as you usually dont think that way about your mates until they do something like that. I guess the truth about people comes out in the end!

I'm pretty sure the max you can claim is $200 without receipts.

You are a nice guy man, I mean 5 grand!!!! Thats pretty a big sum to give out!

I'd say go to court to get it sorted, I'm not sure if the bank can represent for you in court??? Might wanna check on that as it could be powerful evidence.

But keep in mind mate, as selfish as it sounds, you must look after yourself before anyone else (well that's my view) hopefully they do pay you back and you don't have to go through with legal proceedings! I'm sure you won't be lending them anymore cash!

i was planning on buying a new car, i was looking for a vs calais v8. by giving them this money, i have no chance of that for a long time. to me, i was willing to put my needs on hold so that they could be happy. hopefully it all works out well in the end
