    Default downloading from net

Not attempting to commence a flame war here, but I was wondering what your opinions on downloading illegal music and vids from the internet are?

If the content is freely available on TV and internet (Chasers War on Everything), then I see no problem with downloading it from any source on the internet.

As for CDs/DVDs, I believe that if I cannot get it in Australia, then I can download it. So if the movie only came out in Region 3, then I believe I can download it. Or if the album was only released in Uzbekistan, then I can download it.

Otherwise, I am totally against it. Hence why my CDs are all originals.

My opinion is that it is illegal. Copyrighted music and video is protected by the law. Breaking the law has the potential to incur penalties.

Even free to air tv is copyrighted. Technically that means you can't keep a recording of it. It was licensed for broadcast only.

Seems a bit silly though if you ask me...

personally, i dont see a problem with it, as long as the downloader isnt making a profit from the songs/movies they get.

as mentioned above, theoretically, its illegal to record a tv show onto a video recorder, its illegal to record music from the radio onto tapes, etc. but how many people do that without even a thought that theyre doing it illegally.

(on a side note, ill keep an eye on the thread and if it starts getting into bad waters, i will close it)

    my view:

download the music, not an album, just a few tracks from an artist, and then if you like it, buy it

i've bought approx 50 cd's from using this technique, and as a result of downloading i've filtered out the ones i don't like

I don't mean to start a flamewar, but I've been attempting to explain to my two teen girls that not only does downloading from sus sources on the internet attract all sorts of nasties, but that also it might be 'free' but all us honest types will pay more for the music/movies in the end because of piracy.

All i will say is this, if you want to illegally gain material, expect the HUGE punishments that come with it. A single mother in the US was just fined something like $9000 per mp3 she downloaded using limewire.
I won't say of it is right or wrong, as what i think is my opinion and personally i'd rather not voice it

As long as you keep you mouth shut you won't have too much trouble with it, but i'd say support music industry buy it.

you can download mp3s from sites that charge like for 99 cents each song. I'm pretty sure 95% of people can afford that.

Is it true that when you buy the song (CD) it is better quality than the downloaded versions??

yes because true music cd's are uncompressed audio with a replay gain of -3db to avoid clipping

I buy originals for my DJ/Karaoke business for the simple fact that if I get caught with pirated music I'm in a lot of trouble (a big player in the industry recently shut down because of piracy issues) but I do format shift these for my own personal use

What annoys me is fly by nighter DJ's etc coming into the industry with a lap top full of illegally copied songs and managing to undercut the legimate DJ's
If ignorance is bliss why aren't there more happy people around ?

Depends on what you mean by downloading. You can legally download some music from the "internet" because artists make it available. I think what you are referring to is "file sharing", which is using a third party program to download content from another computer, which, unless that person owns the copyright, it is illegal. You are not actually downloading it from the internet, just using it to access files. Having P2P software in itself isn't illegal either, just using it illegally. Same as owning a gun, it's what you do with it. Having said that, power to the people.

Funny that this comes up time and time again.

I've proabably spent close to 3000 on cd's + more on dvd's. I would probably purchase more cd's if the prices weren't so exorbitent e.g. $30 per cd. I download stuff that is hard to find e.g. Import records only available at like $60+ through amazon.com

I disagree with regioning dvd's as the only reason companies do this is to screw people out of a larger amount of their hard earned cash. I rarely watch a movie more than once so I will buy a movie I enjoy when it's around $10.

Refering to the legalities of this in 1976 the supreme court of america ruled in favour of Sony and the people stating that they had the right to tape copy right material. See here > Betamax Case

Since that time major corporations have a larger influence on the justice system in America and the shift has moved from protecting the people to protecting the companies. Back when the audio tape was created companies whinged about how they would loose out and people wouldn't pay money for records. The oposite happened and their business boomed.

I'd rather pay $5 or $10 to an Artist than pay $30 to a company who is only going to pay the artist $1 in royalties.

There was discussion on the copyright issue a while ago, but that aside, if distribution isn't the reason for downloading then I say all music should be freely available. CD sales are a residual source of income for artists, they make decent money touring, and get a pretty good lump sum if they sign a deal with a record company.

On the licensing subject, should Joe Public have to buy a licence to play his radio in his car? If the window was down, other members of the public would hear it too. I inquired after certain licenses a while ago when contemplating opening a coffee shop, a broadcasting licence was one that was required if I was going to have music playing where customers or passers by could hear it.

(Very) Indirectly you do. All radio stations pay a fee to an industry body which licenses them to broadcast any piece of copywrited music in this country. I don't think they have to have bought the original CD. (Most of the material would be given to them by the record companies anyway to get air time and publicity).

I'd happily pay a realistic price for all my dvd's and cd's. The reason my music collection is so small is due to the fact that most shops want 30 dollars for an album that is worth half that at the most.

It's hard when each cd is probably worth about 30c, and the case and artwork inside would probably bring it to 2 dollars maximum.
