LOL - I can't say too much on here, but I wouldn't like to be in the shoes of the person - if a copper - driving cos' there could well be a well known proceeding against him by the Commish - possbily or disciplinary action......

Even if it was designed as a tutorial/educational show on how to control vehicles on dirt, that obviously young drivers and some experience drivers lack...

I dont see what the big deal is, who here hasnt done that kind of thing on their own property?

Being a rural looking area it was probably the local copper. Excuse could be public affairs?

    Haha keeping up public relations.

Well it does seem to be a private property, but i think the police are just going to crack down because it is infact a police car.

Fair enough, say you work for... Ricoh, their cars have Ricoh plastered down the side of them. You take a car home on the weekend, go to a field that you own and start ripping it up, while somebody is filming, its then put on the internet and it gets out. Not a good brand image.

Just as the police are supposed to be supporting and portraying a sensible and safe use of motor vehicles. We have even heard from our own police guru's on this site that if you're caught driving erratically, even if it IS on your own propertey, you can be charged...

lol no "big deal", it's just funny.....

if anything, one could be concerned that our tax money is going towards funding the police some burnout time.... and that while the laws are tightening down on young drivers and 'hoons', because of the very 'unsafe' and 'dangerous' manner in which they supposedly drive, the police are out and about cutting loops in gravel/dirt in company cars with kids only metres away

.... but realistically, this video is a pi$$er - and I hope they go easy on the driver! (if they catch them ) ... two thumbs up from me!

Nope, only if their is a risk to members of the public.

It was reported that local police won't officially back the place. One reason: The offence of "Drive in a Manner Dangerous" can occur ANYWHERE!

That's correct. Even on your own private property driving in such a manner that is dangerous is illegal.

As someone else said, the neighbours might complain. Even if the nearest neighbours aren't close by, someone will still hear or see something and make a complaint bringing attention to yourself.

I really don't think it is advisable to hold a party with the intention of putting on a show of cars doing burnouts and other things similar. With parties you've got alcohol. There's always the temptation to take things further and it could all end up in a coroner's inquest.

Some common sense would apply in terms of what you're driving and what you're doing with it. If you're talking push bikes, they don't really fit the category of "motor vehicles" which is what most of the Victorian Road Safety Act 1986 covers.

Remember also that the offence I specified is "Drive in a MANNER Dangerous". Being the MANNER in which a motor vehicle is being driven.

There's an even better one of "Drive at a Speed Dangerous". That doesn't even need an actual speed reading. It's only if you're driving at a speed that is dangerous in the circumstances. Such as doing 60 km/h through a busy shopping centre car park. 60 isn't very fast, but in the said circumstances it is dangerous.
Quote Originally Posted by VicCop View Post

    64. Dangerous driving
    (1) A person must not drive a motor vehicle at a
speed or in a manner which is dangerous to the
public, having regard to all the circumstances of
    the case.

    Now here's careless driving:

    65. Careless driving
A person who drives a motor vehicle on a
    highway
carelessly is guilty of an offence and
liable for a first offence to a penalty of not more
than 12 penalty units and for a subsequent offence
to a penalty of not more than 25 penalty units.

Notice the difference? Hint hint, it's the bold part in section 65. The manner dangerous offence doesn't mention "on a highway". Meaning it occurs anywhere if a motor vehicle is being driven in such a manner or speed that is dangerous to the public.

There are some that will now argue that this could be implied in section 64. The law isn't like that - what is there is there.

Of course there are coppers who go to these events. Do you know we even sleep and eat too? Amazing I know, we're people too! We're not all robots that see this black and white line between everything.

The whole issue with this party mentioned is that you're planning to have a heap of people get together, booze up and drive around a paddock. You would also be held accountable to this classic bit of legislation:

    49. Offences involving alcohol or other drugs
    (1) A person is guilty of an offence if he or she—
    (a) drives a motor vehicle or is in charge of a
motor vehicle while under the influence of
intoxicating liquor or of any drug to such an
extent as to be incapable of having proper
    control of the motor vehicle

Same as above there. No mention of being "on a highway". This bit under 49 1 (a) is the "drive under the influence" which is the part that says that you don't need to be over 05. That's right. If you're under 05 on a reading but you appear to be ****ed and incapable of driving you can be charged anyway.

this incident happened over 3 yrs ago believed to be on private property...the driver has been located and stood down pending investigation....the action by the copper does not warrant standing down....there have been other more senior senior officers under the spot light for far more serious things that were not stood down....

that said....VicCop is right in that the actions of the copper could amount to dangerous or reckless driving....as Sections 59 - 72 of the RTA of WA cover all aspects of reckless, dangerous, careless, drink driving offences and traffic crash offences on private property or areas to which the public have access whether on a payment of a fee or not...they don't have to happen on a gazetted road.

the element of dangerous or reckless is one that is a burden of proof upon the police to prove in court...there have been cases in court where driving instructors have beaten reckless and dangerous driving charges when caught instructing the learner drivers doing exactly the same thing....the court would have to consider the all aspects of the matter, including the driver's driving qualifications....not just what the video shows....

every copper on here and elsewhere would've done these driving practices on dirt roads whilst under instruction, and being in country areas there are a lot of dirt roads that need to be patrolled...therefore driving skills on dirt roads need to be up to scratch...

yes coppers need to set an example to everyone, but just remember they are human as well with failings just like everyone else....until you walk in the footsteps of a copper then you might understand and can forgive some of the little indiscretions that happen, and i don't mean condoning criminally....theres' more to this incident that what is reported in the media..just like everything else they report...
