How to get money after suing someone?
I haven't posted on the site much cause soon after I became a member my car was written off.
The story: my car was parked on the side of the road and a drunk driver rammed into it and wrote it off.
I payed for a lawyer and took it to court, He did not show up to try argue his case so a judgement was passed and he now owes me $17,000.
I have had the judgement registered so the next time he goes for a credit card, mobile phone contract, house loan etc. it will come up with a black mark against his name.
The problem I have now, He wont answer his phone, is never at the address I was last given for him and I cant get hold of him.
Any suggestions what my next move should be anyone???
Any help will be appreciated cheers.
P.S it was a 2002 VX s2 ex-coppa 5.7ltr

see the police and get them to track him down, if it passed thru court he has to pay you the money, and if he doesnt co-operate then i think its imprisonment for evading payment

Yeah and if he offers to pay $50 a week for the next 7 years then what? Why didn't you just make an insurance claim & let them chase him for the money?

I only had 3rd party insurance and he wasn't insured cause he was drunk and driving on a suspended license

Unfortunately suing and getting a favorable judgment is often the easy bit. If he has no money you will be **** outa luck. Your first step is to apply to the sherrifs office to seize any assets he may have. Beyond that talk to your lawyer as they will have a better idea as this does vary from state to state. I'd be working on the theory of kissing that money good bye and anything you get back treat as a bonus.

Yeh contact the police and c what they can do, if he has anything of value then it can be repoed and sold to give u money. If his insurance didnt cover him i would assume that his insurance company would pay u out, and then they would have to get the money off him be it through weekly payments or property sold. Because its like when u make an insurance claim u dont actually owe the person that you hit money u owe their insurance company. There are plenty of free legal adivce places around mate maybe call in and have a chat. if not brake that c**** knee caps in

Its been a while now, I have been starting to deal with the fact that Im probably not going to see the money.
Just wanted to give it a full hearted attempt at doing everything I can,
I have done a property search etc. doesn't look like he owns ****.
Trying to repo his stuff or make him go bankrupt is an expensive option and I dont want to spend any more cash if it doesn't look like I'll be getting it back.
Anyone know how else you cand find info on somebody - e.g address, uni etc.
I dont want to stalk him or anything just find out if he is definitely still alive and talk to him.
I called his dad but he just said he hadn't spoken to him in months, Probably bull sh#%*ing me but wasn't any help.
Free legal advice places??? What are there names?

G'day, try searching the election roll if he is registered to vote then u can grab his address. As for the free legal advice i have seen bout 3 places while driving down North East Road in South Australia, its just written on the windows saying "free advice". a few of my mates have done it for speeding fines and stuff, they basically give u your options and explain how to do it yourself.

If you are in Victoria then VCAT is your cheapest option. I've used it a few times and had good results each time.
