    Default what a "great" start to married life

    well we just got back from our honeymoon yesterday when one of chloe's friends calls up and says shes just gone into labor so we have to rush to the hospital because they have no one else here in WA all the family is over east so chloe can be with her and i have to look after her 6 year old daughter knackered from a 5 hour drive we go ahead and do that.

    depsite me being ****ty everything goes pretty smooth and i put the little girl to bed and i go to bed myself then i get a call 10:30 that night "ive been in a car accident its written off come quick"

    she was sitting behind a white magna stopped at a set of red traffic lights when some older guy in a pos burgandy falcon wagon slammed into the back of her at full speed pushing her into the car in front.

    the guy lies to chloe and says he has insurance turns out he has no insurance and appearing to be under the influence of either alcohol or drugs he pauses for a very long time and gets confused when i asked for his name eventually the police show up and do a full report the car gets towed, then whilst getting his details he has the nerve to say "oh your wife should of had her foot on the break" she was stopped stationary at a red traffic light there was no skid marks it was a hit at full speed because he "looked away for a second" and he says she didnt have her break lights on !?!

    Too bad it was not the Cruiser he hit. He may not have been able to talk at all if he hit an 83 Land Cruiser at full tilt.

    hey guys, thanks for the comments, she was in the vx acclaim, cause he has no insurance we just had to fork out a grand for excess fee and i just paid out $800 for a rental car because we didnt have rental cover on our insurance policy.

    we went to the doctors today because when we got up this morning she could hardly move her head the doctor said if she was in a smaller car or had no head rest she would of broken her neck and the time for healing could be indefinate so not sure how to go about making a claim as far as thats concerned.

    now once things are sorted out we are on the hunt for probably a vy or a vz theres no way i ever want to even consider her driving a small car ever full stop wish i could afford a later model 4x4 the hj60 is a bit rough for her

    my mother had a similar thing happen to her.

    late one night she was coming home from a wedding with my dad in the car as well. as she was going through a green light a car came round the corner and smacked into the side of our car. the driver of the car was a 16 yo with the car full of mates, all ****ed. they drove off after the accident then came back stopped and shouted abuse at my parents. the cops got there soon after that ( lucky cose i think my dad might hav been up 4 assult if they had of taken any longer). and then to top it all off the kids mother rang us up and abused us for crashing into her car. (turns out this kids gone home after his parents dropped him off at some party and stole his mothers car).

    anyway that was a few years ago and my mums shoulder is only just coming good from the accident. hope your wife's injury isnt as bad...

    Same thing happened to good friends of mine they went and saw a accident lawer and suied they got a good little sum out of it. Its worth a look extra cash is alway welcome

    Geezarz dude. Stuff the car, as long as your missus is ok!! Lucky the guy wasn't aggressive under the influence or things could have been worse. Most likely him ending up in hospital from being smashed in the head.

    3rd party only covers injury to persons during an accident....in other words if you nearly kill someone and they need $100,000 in medical treatment thats what compulsory third part covers...nothing else.
    3rd party property damage is always a good insurance to have if you cant afford anything else, its cheap as (used to cost me $80 each year in my old calais) and that covers you for damage of other peoples cars, eg, if you hit a brand new benz you are covered and wont get sued spending the rest of your life payin them out. imo 3rd party property should be compulsory too...but anyway, you'd be crazy not to have it.

    go see a solicitor... obviously he was in the wrong and now you are out of pocket. dont take any crap from your insurer (NRMA i am guessing?). it was not her fault, she did nothing to cause an accident and now you have to pay and suffer.

    i would skip taking up with your insurer, go straight to a solicitor. get them to send the bloke a letter demanding he pay your excess, doctors bills, car hire and anything else it has cost you. if your wife is looking at long term pain and damage then take it further.

    oh i thought 3rd party covered everything. Never heard of 3rd party property damage before. i've always had full comp. another way of gettin money i suppose. as you say good to have. Been hearing alot of people atm having to pay alot of money due to accidents that wernt there fault. insurance companies being wankers etc

    this happened to you didnt it troy?

    kinda...

    in april i had a accident where a truck lost a load of steel and my car collected it. ended up costing 3300 in extras (hire car, toll damage, material damage and towing fees). NRMA paid their 'up to $500 personal loss' but i am still waiting for the other $2800. it has been 8 months and i havent heard anything. in their words 'we chase up our debt first and then will will chase up yours'.

    last i heard the recovery agency didnt have any claim forms from the other bloke but he insisted to me that he put them in only days after it happened. i have no idea what is going on.

    Don't you just hate it when peope f*** up and they refuse to take any responsibility for it. Seems to be the way of our society now.

    I agree 110%! totally off subject and i apologise but this has to be told. I was listening to the radio today and in the news they told about a pub in carins has stopped its santa saying ho ho ho because it might offend women, they want him to say hey hey hey instead........ WTF!!!!!!!

    Australia is turning into america where you cant pick your nose without someone fag sueing you on some crappy 300 year old rule. its a 250+ year old bloody AROUND THE WORLD tradition!!!     Again a little off topic but that santa story you talk about was a shopping centre in Cairns. He was sacked for saying Ho Ho Ho but the centre dneies that and says he was saked for having a "poor attitude", which translates to he would stop saying Ho Ho Ho.

    Back on track, sorry to hear about the bad start to married life. Mine wasn't much better. On the way home from from the wedding the following day I was rear ended... by my new brother in law. No one was over the limit and wasn't his fault. The car 4 cars ahead of us decided to turn at a cross road with no indicator. I barely missed the car in front of me by going up the inside of the car in front but my brother in law hit gravel and went straight in the back of me. $10,000 worth of damage to my car. The following day we flew off to America for 3 weeks for the Honeymoon where my wife spent most of that 3 weeks dosed up on Xanax because her anxiety decided to kick in

    Something I don't understand is why you had to pay an excess when it wasn't your fault. All insurance companies I know of require no excess when your not at fault and also won't affect you NCB

    That’s what I thought as well. If you can identify the driver, no excess has to be paid. In this case the driver was fully identified so no excess should have been paid. Excess is only payable when the driver cant be identified, (which includes them giving you false details) storm damage, during a riot etc and of coarse when its your fault...

    I'd be doing what troy said, see a solicitor. At the end of the day I see you getting a new car, excess paid back, all expenses paid back and you and your wife on another honeymoon

    evil monkey, have you put in a claim to the Motor Vehicle Accident Insurance yet....? is your wife suffering any side effects from the crash...? if there is any injury she is covered by through her driver's licence insurance part .

    Screw 3rd party, full comp is the only way i'd drive around. Expensive yes, but stuff being in an accident and only having the other person covered and leaving myself up the proverbial creek without a paddle.

    This is in VIC though. Is it different interstate??

    yeah its not compulsory in WA though i rekon it should be, though, though then again some people might not be able to afford it though if they have an accident there going to be stuffed, so yeah...

    My opinion is if you can't afford (at least) 3rd party insurance, then you shouldn't be driving a car on a public road. I don't care what state you live in or how poor you are.

    ok well chloe definatly has some pretty bad whiplash, we just got word today from the insurance company (we are with RAC) the car is a write off but they are forcing us to pay excess fee up front because they want to investigate it to find out who was at fault, beeing a rear ender at a set of traffic lights i cant see who's elses fault it could be. (they rekon we will get the money back if they find out it was his fault but cant give us any indication on when its gonna happen)

    the cop actually told her at the scene when she was giving the statement that he blew over n that he will be going to court over the matter.

    one slight problem for us though is that the woman that she was pushed into in front left the scene pretty quick without giving us any details all i have is the rego number n make/model of car n our insurance wants to hear from her to.

    the guy seems to be sticking to his story of her not having her brake lights on not sure why he thinks making things up like that is gonna get him out of it. i know for a fact that the lights where working at the time of the crash who stops at a set of traffic lights without their foot on the brake in an automatic ?.

    as for sueing the guy he was driving an old POS without insurance i doubt he has a cent to his name it dosent seem to be worth the trouble not sure what to do hey is there any way of getting money from the government 3rd party health insurance ? how do i go about that
