I had a guy come and test drive my car which is for sale on this website about 3 weeks ago and the other day I got a speeding ticket for $220 and 3 demerit points which is on the date and time he came out to look at the car. I don't even drive this car because I downgraded to a lesser model. I rang but have had no luck in getting a response. What can I do?![]()

This is why you have tyre kickers sign a declaration stating that from x time to x time they were in posession of the vehicle on a test drive. Have it signed and witnessed.

Was you in the car ? was it a camera fine get the picture give there number to ya soliceter and see what they can find out for you.
I think the moral of the story is you must see the licence of anyone that comes for a test drive of your vehicle. (having them sign what time they drove the car for is a great idea too) What if they had crashed and didnt have a licence, your insurance company wouldnt have wanted to know about it.
Bad luck. But if you were in the car, why did you allow him to travel at 15km/h in excess of the speed limit???

I think here in SA you can sign a Statutory Declaration to the effect that you were not driving the vehicle. In that way I believe you still pay the fine but do not loose demerit points. Perhaps there is a similar avenue in your state.
Call the enquiries number on the ticket and ask them.
i've heard that in countries such as the US, you can't be fined for speeding unless the police can prove who was driving.
in australia the law says you were driving even though they're not really sure that's true, but what's important is that you pay them the money![]()
It's the same here. For example I see someone talking on a mobile phone driving, I can't just send the registered owner a ticket in the mail. The identity of the person driving has to be established.
Camera detected offences are governed by seperate legislation that says otherwise.
The other exception in law is the 'operator onus' offences, like parking.
