what sort of write off is it? Usually a write off means the car is bad enough to hand in the rego, even if it only be temporarily.

I assume you done a fair bit of work on it and fixed it? Good question!

it was a repairable rite off, the back left got smashed in, so all dad n i did was put a new tail light on so the back brakes can be seen. other than that, its jus a massive dint in the left back quarter panel. damage was valued at 3500$

I'm intrigued as to what you have to do to be sure you can drive it. Never thought about this... Does it say anything in the papers to do with the write off about repairs and registration? Be careful they haven't canceled rego and payed you the difference without you realising.

If the car was written off and you have been paid out for it, it probably isn't yours. The insurance company has in fract bought the car from you at a pre-accident amount.

How so? It wasn't his insurance company who paid him out. Someone elses insurance company can never own your car, if it is classed as a write off you own the vehicle and the insurable amount.

When there is a crash the insurance company decides to either fix the car or "write it off". Often the owner will get quotes and present it to the at fault drivers insurance company who will either send back a cheque (after it is viewed by an assessor) or deem it un-economic to repair it and send back a settlement to the owner which will be usually the pre-crash market value of the car. They have more or less "bought" the car in this case.

I don't know how precise the original poster was with his words but from what he has written, the insurance company most probably own the car unless he negotiated keeping the wreck as part of the deal. Otherwise the insurance company send it to the Auctions and try to recoup some of their loss.

When the Mrs car was written off after some stupid idiot t-boned her, his insurance company refused to take delivery of the wreck. We had to pay to have it moved from a shop to the wreckers. Maybe some work differently, but all cases I know of is that if your insurance isn't paying, the car is always yours. Even if it is written off they have to pay you while you keep your vehicle, I haven't heard of it happening any other way.

It did to my next door neighbor about 2 - 3 years ago. Turned into a fight & a half because the car was old and their offered "book" value was way under replacement.

your insurance company cannot cancel your registration or neither i would think, your insurance without telling you.

    a. they have no power to cancel your rego - it's nothing to do with your insurance (unless they register it as a statutory writeoff, in which case the govt authority will cancel it, which they obviously haven't in this case)
    b. you've paid insurance up to a certain date. they have a responsibility to extend coverage until then, unless some other arrangement is made with your agreement (e.g. if they pay you out for the car)

when my bike was wrecked, the drivers at fault insurance company, NRMA, paid me market value of the bike minus what they deemed to be salvage value. I talked to the assessor and they said because it wasnt me that was insured they could not place it on the write off regisister.
I had no problem re-registering it next time the rego came due.

yeah that's right. it's logical that insurance companies, which nominate whether a vehicle is a stat. or repairable write off, can only do so for vehicles in their possession/ownership.

they can't walk around and decide to make other people's cars unregisterable. would be a fun job though

Ok.... That makes sense. If you took the lower value the car is still yours. Check if the car is still registered and I'd think you would be ok.

a lady ran into me las year. my car (vp exec commy) was a repairable write off the panal beaters told me there was about 6 thousand dollars worth of damage to it. i had to go to the wreckers and get a quote on how much they wld give me. and it had to be writen out and sighned by the manager of the wreackers with the cheque photo copyed and sent away to rentsure (the insurence company of the other driver). they said they would not give me any money until i had sent that away to them as proof. so i really did not have any option but to hand the car over. depends what the insurence company wants to do i spose. they jus said to me take it down to the wreackers and see how much you will get for it and we will pay the rest

Wreckers are wankers. They will give you $100 bucks for you car and make a fortune off it. Strip it and sell the parts on ebay or even calaisturbo....

My mate crashed his car and bent the chasis. The car was towed to the wreckers and he was given $70 for it. He asked them how much they will sell the exhaust back to him (Brand new 2.5") and they said $120...
