Ok so i was backing out of a street side carpark and a mate was telling me about the front of a car that was all smashed so i kept on backing out and was trying to look at the same time. The next ting i knew i was making some rather nice dents and scratches in a blokes nise ss commynow im not they type of person to just drive off so i went in and told him what happened gave him my details and everything else and now it turns out i owe him $500 to fix. But the problem is i didnt have insurance at the time (big mistake i know) and im a student so i dont have the 500 cash laying around.
So my question is where do i stand with the payment? I know i will have to pay but can he do anything if i just pay him off or how does this work?
If he goes through his own insurance company they will cover his repairs then chase you for the money. If you offer to pay them a certain amount that you can afford each week, they will generally accept it.
Let this be a lesson to you. Get insurance, (at least 3rd party) it could have been a $200,000 BMW you reversed into rather than a Commodore!![]()
Some lessons are tuff to swollow. Offer the bloke to pay as you can. He wont take you to court over $500 - yet. Get on the front foot make a payment list with how much you can pay each week. Then stick to it. Give up driving to save petrol. Give up extras until you have paid the man off. Get a receipt for each payment)

its quite clear why hes not going through the insurance company...
he doesnt want to make a claim and potentially lose his no claim bonus and increase his premiums.. all for $500.
edit: i earn $100 a week and pay for rego, petrol, phonebill, insurance and going out. (while in year 12)

Yeh If you cant afford it dont drive, Simple really.
I lived off $40 a week while in Yr 12 and that was doing pizza delivery so I also had the petrol expense aswell.
I managed to pay off my insurance and that was comprehensive aswell.
I think Third party property damage should be mandatory when paying for rego aswell.
Stupid thing to drive without it but you have learnt your lesson the hard way.
I hope it all goes well though and you can get it paid off without too much grief.
i think it's the same for all states but..... it's not illegal to not have insurance, there is two types of "third party insurance", one you MUST have and is included when you pay your rego ( thats why they are so against driving unlicensed cars ) and the other you organise your self.
In this particular case, even if the OP was insured third party, and decided to go through the insurance company - he'd be looking at a 500 basic excess + whatever age excess he has, right? - so chances are he'd still be in exactly the same situation right now.
Having said this, though - thank your stars that it wasn't some blokes candy green metallic 6 pearl sparkle flake brand new ferrari, or a traffic/phone control post thinggie
Other than that, the best thing to do (as already stated) now would be
1) get insurance and never drive uninsured again
2) explain the situation to the other guy, and provide a solution or a series of alternate solutions for him to get his cash with as little hassle for him as possible
if his insurance company were to pay andthey had to chase u for the money the price goes up for admin fees and legal fees.
Id be going to him and just telling him your situation, tell him you will pay but can only afford X amount each week or something.
Atleast youve done the right thing and told him about it and are willing to rectify the issue.
I had a guy reverse his car into mine while I was sitting inside it. His towball went straight into my rear bumper, after exchanging details I called him later to quote him $450.
He said that ridiculous and was expecting to pay more along the lines of $20. After much negotiation he agreed to $50. So I just took it through insurance.
Insurance valued the damage at $650 and fixed it all for me. I gave the details of the other guy over to my insurance company who I would assume would have billed him $650.
If the other guy has full comp insurance, he won't have to pay an excess and even if he initially does, it will be refunded to him. You admitted fault, so you're liable to pay the cash. I also didn't lose any ratings and I was not made to pay an excess. And why should I?
3rd party wouldn't have helped you here as your excess would most likely be much higher than $450.
Suck it up mate. Nothing you can do. You caused that much damage to his car, do the right thing and pay for it.
