My car was parked out the front of my dads place the other week, with the passenger side wheels up on the gutter. Its a small street, so if the whole car is on the road, only 1 car can get through at a time.
Its one of those gradual slope sorta gutters, no different to the driveway entrance really.
Now I received a parking fine IN THE MAIL (they didn't leave it on the car), for $52.
The offense is listed as parking on a "PATH, NATURE STRIP OR DIVIDING STRIP".
Now the car was NOT on the footpath, and I thought a nature or dividing strip would be the median strip things in the centre of the road, not the bit of dirt between the footpath and the road.
Do I pay it, or argue it? The only reason I park that way, is because it is safer, both for my cars and for the vehicles driving up and down that street.
I would fight it, to me it sounds you did your best to make sure everyone had room. Unless one of the neighbours have complained about it again and again I cant see why they would bother.
The nature strip is the section of grass/dirt out the front of your house before the road............unfortunetly you have to pay it mate.

Strictly legally, you have to pay it. Having been through the court process myself, I can tell you that if you took it to court, you've got better than a 50/50 of being let off, depending on your circumstances and income.
But for $52, it's not worth the hassle of court proceedings.
If you can find somewhere in the letter of the law, that your vehicle must be on the grass verge or pathway to incur a fine, and there is no mention of gutters - then ask for a picture. The picture will confirm your wheels were not on the grass, and you should be able to contest it outside court.

Thats what ya get for trying to be considerate to other road users. My street is also quite small, the neighbours often have parties as do I and when we do the street is barely usable so i try tell my mates to park on the nature strip. Didnt know you could be fined for it.
Yes, its no different to parking on the driveway entrance, that will get you a ticket too.
The land separating a property and the roadway is a vehicle free buffer zone, it is not for parking, it doesnt belong to the person that owns the property behind it.
Maybe in your eyes you were doing everyone a favour by not parking in the street, but you can still everyone a favour by not parking there.......![]()

Nature strips are council property, not house owners property, so parking on one when you aren't supposed to is parking on a public space you aren't meant to. If it was private property, then it would be different.

There is legislation that does not allow parking on a nature strip. I cbf finding it, but it's a legit fine.
You violated the legislation, straight up. I know it's a dog act ticketing a car like that, considering it's you were doing people a favour, but it's breaking a law nonetheless.
Seeing as you broke the law, you'll need to think of a very good reason why you broke the law.
My mum got a ticket for parking in a 2hour bay overnight. The ticket was over $120, a towing receipt and a receipt showing work done from it overheating got us out of the ticket. Although the car was legitmately undrivable.
I reckon just suck it up.
Yeah, by the time you fart ass around and fight it for **** knows how long, it would have just been easier to pay it and have it over with. You have spent heaps on your car already, what's a little more really.
i had my ute parked in a clearing with FS signs on it and got done for it. in no ones way, well clear of everything, in the end i just paid it. you never win with councils. i waited till the last day, lol i wish i did just out of protest but i did it because it was the only free time i had...
