I just have a little problem with a question involving my daughter see I had my daughter to my girlfriend and are no longer living with them yet I pay maintenence (of course) so my question is is she a dependant (on me)???
I`m leaning toward yes but there is not one shreed of detail on this situation in the return booklet.they should me more forthcoming.
No, she is only a dependent if she lives with you for all or part of the year, then she can be claimed as a dependent on a pro-rata basis. Child support payments made to her are not taxable and you can't claim a deduction on them.
No offence but you didn't look very hard. Here is the ATO definition of a dependent:
Dependants and separate net income
As NAAF already said, your child is not a dependent as she doesn't live with you.
C.
Seriously, best to call the ATO directly, they are generally very helpful![]()

It can get tricky. Technically no, but if the maintenance stopped would she struggle? It can actually be deemed a dependant even if not living with you. If they can live without you comfortably, then no. If not, yes.
But as has been said, call and discuss your exact circumstances with the ATO. Remember to make notes of the conversation, date and time stamp and the name of the person you spoke to.
Cheers!
Cheers guys, about the maintenece issue that was again highlighted by CSP, there is without a doubt a time when a guy in the same situation as me has contemplated this and got answers from the ATO so don`t you think someone at the ATO would at least try to put some reletive info on my situation in the "info" booklet so as not to raise any doubt??.
The third bullet point here is irrelevant. You pay child support only and you stated the child doesn't live with you, so how do you deem the child to be a dependent?
I believe you will find if you ring the ATO, they will advise you that you cannot claim your Child Support payments as a deduction, nor does paying Child Support make you eligible to claim her as a dependent unless she resides with you either full time or under a shared care agreement.
I'd recommend proof reading your posts before submitting them. What are you trying to say? You submitted your return on the 2nd July and expected it back on the same day?
I havent even got my group certificate yet (has to come from Dublin). I should have my tax return back by the end of August.
I seriously doubt you would have received it in your account on the same day you lodged it.
This thread reminds me I need to do mine.
