    Default Cityrail Guards - Rights?

    My mate was pulled aside by a train guard today and was told to produce I.D.

    I just wondering what rights train guards actually have because i was under the impression that a passenger doesnt legally have to present I.D to anyonen but a police officer?

    simple tell them you have no id, they cant do **** but kick you off the train and/or give you a ticket. say your names jo blo......


    Im not sure on the actual laws of that but id assume its the same as a security guard, they cant do things likethat but can hold you under arrest until police arrive.

    in melbourne they can detain your until police arrive, and i think they can detain you until you can produce ID, although this may be part of the cops arriving bit.

    down here they're big fans of some old fashioned throw you down with a knee on the throat action. pretty fascist if you ask me, and they generally don't give any lenience if you couldn't buy a ticket at your station due to faulty equipment.

    hardly anyone in sydney buys a ticket

    i was on the train and the guards were coming and people just started getting up and walking to the other end of the train. then get off at the next stop.

    But the train system is such a failure here i dont blame them for not buying a ticket

    i didnt mention a specific generation.

    There were 35year olds in suits heading the other way when they saw the train guards checking tickets........

    Last i heard cause they were whinging a while back, because they have no right to make people show i.d. and they couldnt even detain them because they are not allowed to touch them. But i dont know if from that whinge a while back if they actully did anything to change the laws for them

    My post was meant for the OP, not your ticket evaders. I agree with them in Sydney! No point paying for crap, never on time, service.

    he never mentioned anything about his mate complaining about doing whatever he wants. he was just asking a question about a persons rights.

    There is also nothing on the Cityrail website stating that ID must be produced, only concession cards and/or tickets as requested, so in short they can ask but you do not have to give it to them

    iv been asked for id on a train only once, i told them i didnt have it and offrered to call the police for them if they wanted to take it further. Its not an offence to travel without id unless you have a student ticket etc. I would be making a complaint if i was touched by any train/bus/tram ticket staff, i wouldnt resist but i wouldnt let them get near me. i guess thats because i get edgy when im in enclosed areas etc.

    the reason they can't carry it is due to most current batons have to be extended, try doing that in a crowded train whilst aproaching an armed/violent offender..... The old school one piece ones were banned I believe... correct me if I am wrong

    Yeah i know in Melbourne they cant detain you untill police arrive if you either refuse to present ID, or dont have ID on you. Its funny on trams, the inspectors get on and they are always 3 little indian blokes. They ask you for a ticket you just walk off the tram.

    ive seen on the trains, the signs saying inspectors have the right to detain you, etc etc. i wonder if its all bull crap so you feel compelled to tell them the truth in the first place

    ^ ive only caught the train a few times over the span ofmylife and jumped every single one, the way i look at it its a courtesy means of transport! ...never once seen a ticket inspector or guard, i was even ****ed one night and was in the front room with the driver and he was showing me how they drive them and little tricks you may never guess...like radars for trains, the same as car radars!

    you see them sometimes in melbourne. never on peak hour though, cause they wouldnt be able to move through the carriages. but the station i get off at, you need a ticket to get through the gate things, and sometimes theyll have the guards there watching. also, if you use a concession ticket, a light comes on and they jump at you asking to see your card.

    the only station that has guards checking tickets here is when your leaving central station in the cbd (gates) otherwise ive never seen any guards on a train before in qld.... i hate trains and bus's anyway always avoid them.

    My mate told them a bull**** name and they said he has to wait with them till the cops get there, as soon as the train stopped he bolted out the door.

    The only station ive seen people checking tickets is Melbourne Central.

    The only reason i go to the city is to drink and im usually all covered in chains, studs and spikes so if they want to detain me be my guest. I usually just buy a ticket though its like $2.50.
