hey guys, i'm in nsw and work in retail at the moment.
i recently resigned and i finish up next week.
now what i'm wondering is when u resign do u get holiday loading on your holiday pay out?
also when i resigned we put that i would finish up 3 weeks after the letter was dated, now i've heard that you only have to work 2 weeks after resigning, so when i get to the 2 week mark would i be safe to leave?
i would ask at work but my boss is being a douche about me leaving, i feel wierd being there still...
any info would be sweet. i guess i'll find out next week anyway.

No you won't be entitled to loading. All he has to do is pay out any annual leave you might have. As for the notice. If you've given 3 weeks then work the 3 weeks. Otherwise you're not honouring your word and he won't make a very good reference. Might come back to bite you in the ass in the end.
Im not sure about NSW but in WA when u finish up u get your holiday pay paid out to u (without loading im pretty sure) and any long service leave you've stacked up aswell, you dont get sick days paid out but..
Are you on a state or federal award or a workplace agreement ?
The amount of weeks notice you're required to give depends on how long you've been there, the longer you've worked the more notice you're required to give but if both parties agree the notice period can be forfeited

man im not looking for a reference anymore...ive already got the new job sorted out...
long story but ive got the s**ts with work and i'm sick of being treated like a sack of crap. when u have over 7 weeks of holidays saved up and u have an uncle and a best mate getting married in the same month, you would think u could maybe get a little time off to go to their weddings, but no, i cant even have the weekends of the weddings off work.
sick of working all weekend for normal pay because 'our comission covers it', having to work nearly every damn weekend for all of my 18th and 19th year of life, i'm just over it.
then being threatened with my pay for taking a sickie, in two years ive been sick twice, how weak does a boss have to be when he threatens that...i know he has no right to refuse pay as it was only one day off, but still just shows how ****ed up it is...
i didnt wanna rant but u know...

Leave after 2 weeks, you lose 1 week annual leave.
You agreed on 3 weeks that's what you have to do. If you leave prior your boss is entitled to dock your annual leave for the days short of your agreed termination date.

thats what i wanted to hear...so theres definitely a draw back to leaving early.
yeah as i said i was told that the minimum standard amount is 2 weeks.

If u do call in sick for the weekend of those weddings, he cant withold your pay can he? people get sick, and people call in sick, its happens all the time in retail, are u a member of the union? sda or somthing simillar? talk to your union rep cause if u do just call in sick, u can claim some of those sick days that you're not going to get paid out for
you've worked there 2 years and u have 7 weeks owing to u, that means u've only had a weeks leave in 2 years? that sounds like hell.

The union will do SFA.
They will just tell you what you can already find in the EBA.
If the boss is being a prick, just have a few sick days at his expense during the week. You are usually entitled to a few before a medical certificate is required.
I just resigned from my current job.
I gave 4 weeks notice, but my contract required 2 weeks. I gave the extra to tie up loose ends on projects and prepare a handover.
If I leave early, I forfeit.
I'm getting paid out 4 weeks annual leave, and have a week and half before I start my next job so thats a nice change.
