    Default deposit on bike

    just put a deposit on a bike the other day and now the bloke rings me today ( the day im supposed to pick up the bike) saying that he has been offered another 500 bucks more by another bloke. where do i stand on this. i did get a reciept from him.

    Not much you can do mate, unless you paid the amount in full, a deposit is only a sign of goodwill and not legally binding. Unless he refuses to refund your deposit, in the eyes of the law he has done nothing wrong.

    As I said, its a gesture of good will. Unless legally binding papers are transferred, you do not legally own anything and the owner can choose to reneg on the deal.

    Have you seen the amount of paperwork required to place down a deposit on a house, and have amounts forfeited if either party passes on the deal? I can assure you its far more than a piece of paper saying you paid a bit of cash.

    Deposits on goods are merely holding deposits, showing your good will. They are not legally binding. I guess its just a good lesson to learn, if you have the money for an item, then and there pay it and transfer papers.

    If I'm happy with a car or a bike, I'd check it out in the morning, finalize the money and pay it by the afternoon to avoid situations like these, no deposit needed.

    if i was selling a car and got a deposit off someone, i wouldnt sell it to anyone else, because ive agreed on its value already. end of story. thats just shallow if you ask me, when i put a deposit on something i expect it to be held for the agreed amount of minutes, hours or days.

    Sounds a bit dodgy to me. A couple of things could have happened there, 1. either he is actually telling the truth or 2. he has realised he is letting it go too cheaply and will relist at a much higher price, but the question i have to ask is, is it worth you paying the 500 extra? even if you mention doing it and see what he says then, if he shies away from that too, refer to possibility number 2.

    Either way, it's a bit of a dog act, no matter if he is legally within his rights to do it or not. But saying that, he could have just sold it on you and had the deposit waiting in cash when you came knocking.

    But long story short, sounds like he wants to relist at a higher price.
    Suss him out.

    I had a legally binding contract that forbid the dealer from selling the car for 10 days when I put my deposit down?

    Check with legal aid I reckon.

    to me a deposit means a sale is finalized (agreed by both parties) pending the rest of the payment, id say either demand the money back if he says no, say you will seek legal action if he dosnt pay back (try and scare him to getting the money back) cause im guessing you probably paid a couple 100 dollars,

    if you know where he is go to his house with a mate, alot of people are hero's on the phone but will fold in person

    Dealers are different. They have legal documents, drawn by lawyers, and they are a business, so the laws are different with a formalised money trail. Private sales are completely different, there are no formal documents, and just saying "deposit taken in the sum of x dollars" signed by both parties would never hold up in a court of law.

    Legally there is nothing you can do. Morally the guy is scum.

    Just go pick it up and thank him for honouring the deal. Just cause he said he got offered another $500 dosnt mean you have to pay it, hes just letting you know. As said the nice thing to do is thank him i recon.

    I'd be doing what the guys above said, if he gives you back your deposit, which he should then you're all good.

    But I'd call somewhere and see what they recommend in case he doesn't give you it back. Could be bad though because if you paid in cash he could nearly turn around and say, what deposit?

    But if you end up not getting the bike and you do get your money back, I hope they guy that has offered 500 extra doesn't come through in the end and the guy ends up not selling it. I hate people that don't honour their word.

    hey guys i ended up getting the bike. i rocked up at his house after he sent me the text message saying he wanted 4 grand. i didnt reply to the message and i said my phone was turned off. he asked me whether i got the message and i said wat message so he said oh k dont worry bout it and i got the bike for 3 and a half. bonus

    Exactly, sounds like the outcome would have been the same irrespective of what path you took.

    If you asked for your deposit back, no doubt he would have done the same thing, and said something like the other sale fell through.
