    Default defect?

    Just a quick one.....lets just say a car has wider wheels on the back then the front.....eg: a car has cop rims, but the fronts are 15x6 and the rears are 15x7's. Is this defectable at all?

    We're having problems with a lad we sold a car to. We helped him out by giving him the car first, and he was to pay up that following weekend, and we also said the wheels, speakers, battery and rear springs have to be returned. He only wanted it for the motor so said it would be ok. So he took the car. He paid up that weekend, but after 2 months he still hasn't returned the gear which we strictly told him wasn't apart of the deal.

    We've been on his back about it since he took the car, and tonight when we went to see him again, he said he was under the impression that the wheels come with the car, as when u buy a car it normally has wheels. I refreshed his memory on the deal we made, and he even said he remembers me saying they weren't apart of the deal, but he thinks their his coz a car should come with wheels.

    Apparently he's got the rego changed into his name even tho we haven't signed anything to say we sold it to him (we weren't gonna give him the papers until we got the gear back). We're gonna get a rego check done and if it's still in our name I guess we're legally allowed to get it back, even if that means we break the ignition and bring it home....coz technically it would still be ours. If it is changed into his name well there's isn't much we can do legally.

    This is why I ask about the wheel width question.....coz I figure I could tip off the cops about it and they could chuck a defect on it....he's not exactly in their good books. He's now decided to sell it too, and apparently someone is coming on Monday to take a look....hopefully we can get something done b4 then.

    Sounds like a dumb move givingthe guy a credit. if he didn't get any paperwork and hasn't paid anything just report it stolen.

    shame hes in SA, but it should be the same. wheels and tyres must be the same per axle, pretty sure theres a max difference, ie no bigs n littlies, but 1" difference should be fine.

    did you get everything else back from him?

    Not illegal providing it still meets the track requirements.

    TSA states front work as a pair, and rears work as a pair.



    On the part of the car, registration isn't ownership. Just go get the car when you feel like it, even if he has changed the rego. All it takes to change registration is knowing all the numbers matching the car, so thats probably how he did it without the papers.

    Yeah I know but we trusted him as we know where he lives and his old man lives down the road. We aren't really mates, just knew of him and he said he was urgent for a motor for his other car coz he needed a car to get to Adelaide, sumfin to do with his kids.

    He paid up the cash, just hasn't returned the bits. He's not all there 'up stairs' so I might use that to my advantage and just con him a bit...we should be able to get him to bring the car around, then as soon as he does one of us can occupy him while the other jacks the car up, removes our wheels then drop it back on the ground on blocks.....then he has no option except to find his own wheels. Only need to get one wheel off without him knowing coz from then he can't go anywhere lol.

    This is true. On your registration papers it states that registration does not prove ownership, so technically this car and all attached parts still belongto you, even the motor if you really want to get at him. Easiest option would be to ask him very kindly and then vry wickedly tell hime to hand the crap over or you will report it stolen. Hes got no proof so he would be stuffed.

    Also how the hell does he intend to sell something he doesn't own. He has no proof of ownership, does he intend to deal in stolen goods, does he like jail. Call him up and remind him not to bend over and pick up the soap.

    LOL!!!!! That would be funny.

    But yeah, what a dog, although I wouldn't have given it to him with my bits in it though. But anyway.

    What a knob. He purchased the car under the agreement that the wheels and stuff were not a part of the deal, and that you were trying to do the right thing by letting him have the car with those bits still attached.
    That is all there is to it. Not then to say "oh......but don't all cars come with wheels???"

    Thx for the suggestions lads. One thing tho.....if the rego papers don't prove ownership, then how can I prove it's mine? Also one thing which I forgot about till just then, the car wasn't in our name lol. We got the papers when we got it off our mate, and we never changed the rego over coz we didn't plan on keeping it. But I asked my mate last night (who was the registered owner when we got it) and he said he hasn't been contacted by anyone about it either.

    So how could I prove ownership? I could easilly get a letter from the guy we bought it off saying we purchased it from him. Not sure if that's enough tho.

    I was talkin with Mum last night....and she rekons we should go speak with his Dad and see if he can sort it out.....I didn't even think of that lol. Would prolly be the next best step.....then if that doesn't work go to plan B of trying to lure him around here so we can nick the stuff back.

    He's also selling a half wrecked VH which has 4 wheels on it. I asked him why he didn't wanna just use the wheels off that, and he said coz they're 14's. He rekons he has a mate at Holdens that said the VK's come out with 15's so 14's would be illegal. Then Brad told him he's full of **** coz he works at Holdens and they all come out with 14's except the Calais' which were 15's. We even told him to check the tyre placard but he refused, I guess he knew he was talking out of his ass and he knew we were right.

    Don't ya just hate people who THINK they know everything, especially when u KNOW they're wrong. He even tried telling us he had some 15x9" cop rims but he can't use them either coz the cops don't like them. I said the widest cop rims available are 15x7's, but he assures me they are proper cop rims, just special ones.

    i was under the impression that rego does not legally proove ownership. if you have a recept from the guy you bought it from, that will help.

    if he is not all there up stairs, just take the car back off him, ask to borrow it or something like that, or a s said before just speak to his old man,

    The wheels wouldn't be a problem, most stores actually sell thin/thick wheel sets.

    But about your pickle of a situation, If it comes to taking wheels, invite him over to "finalise" papers and while he is inside take one (all) off....

    Have you had the car insured in your name before? That should help to prove its yours.

    Missed that bit. Unless you mean currently, i mean previously, proving that he 'owned' the car at some point, as opposed to this guy who just happens to be in possession of the car.

    in qld that is illegal, it just wouldnt pass the safety inspection.

    remember this though. rego isnt proof of ownership. did you give him a recipt for the sale of the car? if so, it's his. regardless of who it's rego'd to

    Different size wheels on the front and back are illegal unless that's how the car came from the factory originally. I.e. has passed ADRs.

    As for the rest of the OP, it seems to all be just a tad OT.

    Transport SA seem to think the axles run as a pair. The specific example i asked was 21 on the front and 22 on the rear. They think thats fine. Also matched the ADRs i have.

    i believe ADR's can be over ridden by state laws though. A few state laws do state all 4 wheels on all axles must meet same sizes. Now the problem there is, aren't there many import cars taht run 2 different sized wheels?

    what is it the police say? REASONABLE FORCE can be used to retrieve property. but ring the cops and ask what reasonable force is and they will tell you anything that doesn't result in them getting called. LOL

    In Victoria you have to sign transfer papers (disposal) for the rego to change names, unless the car is sold unreg of course.
    How did the rego get transfered to his name? Did he just forge the signatures or sumfin'? Would be interesting to find out if he is guilty of forgery!!! Maybe asking him how it was transferred to his name might be enough to worry him, or tell him you are going to the rego authority as you or your mate gave no permissions.

    I have different sized rims front and rear. Came that way from HSV.
