My nine year old brother got a letter today telling him that he needs to attend court this month for not paying a train ticket he didnt even get november.
the time was 6/11/08 at 10.50am he was at school.
we were told if he dosnt pay it he will loose his licence witch he dose not have because he is nine
we rang up telling the court it is stupid they want us to go to the court with a birth cirtificate or passport to prove it is him but doing that means dad has to miss a day of work for this bullshit
were not going to rock up and see how far this gets

Just sounds like its a case of mistaken identity..whoever was meant to recieve the letter obviously has the same name as your brother.
Or have you thought that maybe he ditched school for the day lol?

Either way go and prove his innocence, sign it over and there shouldn't be a problem. In this case they seem to be providing him with an opportunity to show that it wasn't actually him - that is the legal system providing a safe-guard against mistaken identity which (not witch) is always going to happen.

Firstly ignoring a court order is going to cause further problems. I would investigate if the child actually attended school and was present at the time of said offence, then if so take a letter from the school to the court to clear his name.

I certainly can't speak for all primary schools but the handful i have worked at wouldn't know for sometime if a kid had wagged. We take a list of a morning in the class then send the list to the office at the school i teach at. It could be 9:15 by the time we mark the list, 9:20 by the time it gets to the office and anything up to 1pm by the time the office staff have entered this list into the computer. At 2pm we do it all again.... That leaves quite sometime before parents would be called even if this system was used (which it is some places, not others).
There are certain kids who for family reasons are away often, we tend to not think too much about it when they are away. Some families seem too thick to write a note or make a phonecall.
We have 700 kids walk through the gate anywhere between 8am and 930am.... yeah right!!! Once i mark names down it could be 11am before i have a break to get to the phone to ring a parent to see where the kid is - if i have to leave a message it is then almost 2pm before i have a chance to see if they have called me back. Little Johnny could have had a ball around town in that time.
I'm not saying i like that the system works like that, but that is how it is and while we have truants we will have problems.
OP - As mentioned above the Principal should be able to sign a stat dec to say your brother was in school .....if he was actually there.
I really doubt a 9 year old would skip school or be smart enough to get his name marked off the role and wag ,someone has given false details
As for the letter we should start another thread for the most stupudists letter you have ever recieved from a goverment department or business
I once recieved a letter for centerlink years ago saying I had to repay them ,because I died 2 months before and they werent notified, I was really puzzled why would they address a letter to a dead person?
also A friend of my recieved a cheque from a goverment department for twenty cents ,he framed it and hung it on the wall
Doesn't work that way in most primary schools. Also if a letter is sent with the kid it won't make it home. If the little truant is clever enough to skip a day then he's also clever enough to keep an eye out for a letter from the school in the mail or write himself a note signed "mummy" explaining his absence.
I still don't understand how a 9 year old is smart enough to skip school and get away with it? What the hell does a 9 year old do whilst skipping school and where does he or she go? If he or she skipped school by itself where would it hang?
Hard for me to believe, but then again, it's been 14 years since i finished primary school. Kids attitudes and ways of life have changed alot since then. Back when i was 9, i wouldn't have dared to skip school, it was one of the dodgiest things you could do back then and we were all shit scared of our parents blasting us for it lol.
Yes, they do skip school - usually a product of their upbringing. Welcome to the future. He probably wouldn't bother getting marked off the list - check my last post about how the checklist works.
You friend needs some nice prints or some artwork... There is some irony in that the cheque cost him time, potentially buying the frame, framing it and hanging it. I hope it was worth the 20 cents he didn't end up getting!
Had an 8 year old skip coming to my class one day, not the brightest though he went to the skate park... which shares the grounds of the school's lower oval. Didn't take long to find that one, but that was a small school in a small town. Wouldn't have a hope where i am now.
All private schools I know make a contact call to parents when the child is not in attendance. Found this out the hard way. Funny thing is, I warned my little cousin about it...what does she do...yup she got caught.
I know some government schools do the same thing, but i doubt many would as they generally have less staff etc.
I find it hard to believe a 9 year old would wag school then be able to catch a train etc over an hour away.
I am unsure as to whether they can issue a fine to a 9 year old anyway? I doubt it would have much standing. I'd go just to laugh about it.
