    what were you doing at the library?

    It can't hurt to try and get out of the ticket, although you are providing print evidence here that you were at fault so i wouldn't point them in the direction of this thread!

    I'd say you've already spent your $70 worth of time thinking about it so for a nominal amount is it worth more time? I'd have contested or paid - either way get on with it or you end up investing more than it is worth.

    I tried to fight a parking fine a while ago. lost out about $200 more than the original fine was.


    It was bullshit tho, a small shopping centre sold some of their land, and built a medical centre there. But NO carparks were allocated for the medical centre (only the staff carpark around the back, that wasn't accessible).

    Even after ringing the council they still wouldn't budge. Not that i'm suprised tho, its exactly like local councils here to approve a development for a medical centre (which will have people needing to park there) without a carpark!

    Yes laws are laws, my post never said a law wasn't a law, i said some laws are stupid. The only parking laws that should be enforced are resident parking!

    Because a parking infringement notice was issued by Council it doesn't automatically follow that you will have to pay it. You need to check the signs were in fact present and correctly installed, that the lettering on the sign was clearly legible and that the sign complied with all necessary regulations (i.e. it was installed lawfully in conjunction with the relevant council authority - to do so). If you want to go to the trouoble, you can access council records to ascertain the date the authority was granted for installation of the signs. The signs should also have some form of unique identification on them - it will relate to the the enactment of the by-law (regulations) pertaining to that particular parking zone. Frequently parking restriction signs are installed illegally and as such breaches of parking regulations are unenforceable. That's what you need to establish to have your fine cancelled.

    First time I've parked at that spot I usually park over near centerlink, Try to stay away from where others will come and go...have enough dents on the cars from careless idiots.

    Does this mean in theory at the local shops I'm allowed to park in disabled spaces despite being able bodied and not having a permit to do so (not that I would because I'm not a prick) because the carpark is the property of the shopping centre and the only people policing it are the shopping centre staff?

    On this topic it's annoying when people who don't even have a baby seat in their car, no kids or baby on board and decide to park in the "parents with prams" spaces because all the other spaces are full.

    Also annoying is the Disabled people parking in the Post office spaces, usually in the middle of both, so no-one can park either side, if their disabled parks are full. Rules apply to everyone, its not 'post office only unless disabled parks full'

    frankston is much worse that $70 would have been $115 in frankston and ticket inspectors are everywhere. Even the local tafe is regurally patrolled 3 times a day by ticket inspectors and if you dont have a sticker from chisholm you get a fine (even though you might actually go there) I've even seen cars with stickers still get a fine

    You dont know the car park.Where he was parked has been the center parking for as long as i remember.If you knew the spot a bit better you would understand what i meant by them being harsh.

    In that case the word 'unfortunate' would be best. Harsh implies they did something to him that he didn't deserve. Unfortunate implies he was being a dud and got stung for it.

    What makes you think that? A statement from the issuing officer is all that's needed. Then its your word against that of a Police or Council Officer. I know who's word the court will accept.

    Ben, you'll have to pay that one. Whats the bad thing is the council office is right across the road, so they always are watching over that section.

    I parked there once with a Zone 1 (Green) permit [i only got the permit the day before]. I found out the hard way that you need a Zone 2 [Z2 or A2 whatever they call it now] Permit [Red]. And yes, it's for workers in the shopping centre, same as the Zone 1!

    In Australia you have to be proven guilty for just about every criminal act, plus i used to work for a towtruck company towing illegally parked vehicles, photographic evidence was the only was to prove the car was parked at the place we towed it from with a time & date stamp otherwise our 'customers' would get their cars back without paying a cent.

    Surely a parking fine is'nt a criminal act though. It's a civil matter.

    You are correct the burden of proof for a criminal and traffic offences is 'beyond reasonable doubt'. However there is a big difference between the activities carried out by Police and Council rangers than the activities carried out by you.

    Firstly Police and Council do not tow vehicles they simply issue infringement notices at the location. The officers word that vehicle ABC-123 was parked in a certain place, at a certain time, on a certain date, in contravention of a certain law, is enough in a court of law to prove the offence. As is the case with red light tickets, speeding tickets etc, etc.

    The activities you were involved in obviously involve towing vehicles that are illegally parked on private property. In this case photographing the vehicles is an arse covering excercise to prevent the owner of the vehicle making an allegation that you stole the vehicle.
