My recent fine

Ok I can admit what i was doing was wrong i wont deny it at all but under the circumstances in which it happened annoys me.

I was on my way to pick my friend up from work traveling thru a school zone that has amber flashing lights WHEN there a lolly pop people there who indicate that it is in fact a school zone, when i was going thru said school zone there was no lights and there was no lolly pop person so i proceeded to do 60 ks which i admit is 10ks above the 50 in which the zone should of been but i got dinged as if it was a school zone so i got done for 17 ks over instead of the 7 ks over.

Based on whats been said above do i have a valid case to dispute the charge my fine was $150 and 4 demerits? I didnt see the damn multi nova coz it was a rear facing one that catches the back number plate, I'm not even absolutely positive it was me driving coz i lend my car to people all the time as long as they have licenses of course.

well. it depends, school zones in Victoria have clear signs that say "School Zone" and "School Zone speeds apply blah blah" and it lists the hours the speeds apply between.

Then as you exit the school zone, a fresh speed sign is waiting for you with the normal speed, if it is outside of the hours listed on that sign, you can go through at whatever the street speed limit is.

yeh we have those signs and i believe it was after 4, and i also believe those lights have to flash amber till after 4 and the crossing guards must remain present

yeh says 3:57 but im convinced it was past 4 based on the lack of lights and crossing gaurds

school zone time is 3-4:30 here but yes if the yellow lights arent flashing it seems a valid reason to atleast contest it

Some school zones are different, some have a 40k limit, some have a 50k limit, some have a 60k limit, all of which change to 25 at the appropriate times.

In SA, ours say '25 when children present' if the lights aren't flashing, not sure how they would work this system if it was a mobile radar car, being they couldn't possibly detect a child and then enforce the lower limit.

yeh in wa its 2:30 to 4:00 as our school finish at 3 but yeh i understand every1s perspective of time is different but its 3 minutes and the warnings werent present

Keep in mind when you sit for your license, you get taught what the rules are regarding school zones, so that if a sign is missing or damaged you know how to act.

as tvr said, challenge it but be a bit cautious. I mean if you could get real technical and ask them when their clock was last calibrated.

The clock in your car said 4:00 , no lights flashing, no lady and from what you were taught means that you could go 50. I'd say you've got a pretty good case, due to the time of the offence.

If you were doing 50, you might have a case, but given you were speeding regardless, I think you'd have a hard time convincing a magistrate you were well intentioned, just misled with regards to the time of day.

Call a lawyer if you really care that much. Do you stand to loose your license if you take 4 points?

If it were me, I'd just cop it on the chin. You may be right that the lollypop lady had clocked off 5 mins early, or maybe the camera's clock was out, who knows. You won't be able to find out without taking the matter to court.

Slow down and pay attention to road signs (I assume speed cameras are signposted in WA?) then those 4 points shouldn't really matter in the long run - boring advice I know, but sound

i do understand all that mate but im not just doing it to cover my ass i think it puts a valid point across about why those people are there

in Qld we don't have the flashing lights or lollypop people in a lot of the school zones
but we still get fined if we go over 40

How do you know you were picking up a friend, that there were no lights or anything if you don't even know if you were driving the car? I'd say that explains your rights right there.

im almost positive it was me driving coz thats the back way in which i go and its quite a common occurrence that the lolly pop people leave early but the lights r still left on until 4 o'clock
